Damages for non-completion. If the Contractor fails to complete the works by the date stated in the Appendix or within any extended time, under Clause “27” here, the Contractor shall pay the Employer the sum named in the Appendix as " Liquidated Damages" for the period during which the said works shall so remain incomplete and the Bank may deduct such damages from any moneys due to the Contractor. The recovery of Liquidated Damages shall be quantum of liquidated damages per week (or part thereof) shall be 0.25% of the gross amount payable and subject to a maximum 10% of the gross amount payable. 28)
