This article deals with the main features relating to the formation, qualification, content, and non-performance of computer contracts, defined as those which have as their object computer goods, in particular data, computer programs, and the provision of computer services. It does so from the viewpoint of Portuguese la. It aims to consider the specificities and practices of this market and addresses the particular case of open-source licences.
