A TEORIA DOTeoria Do Adimplemento Substancial Dos Contratos • June 17th, 2010
This work has as main objective to verify the possibility of applying the Substancial Performance os the Contracts‟ theory in Brazilian Law, which allows the alleviation of the negative effects of an obligation breached, including preventing the resolution of contract, provided that the breach is not burdensome. We will analyze the history of related institutions, principles of the theory in question, its practical applicability, always including doctrines and jurisprudence enlightening, so we can conclude the issue objectively.
