Additional Undertakings. The Borrower, directly or by means of the Promoter, shall:
(a) promptly inform the Bank of any changes occurring with regards to the Project Implementation Unit;
(i) ensure that adequate environmental and social management plans, defined according to the legal requirements and related documents, are implemented and monitored during the construction of the different schemes, namely in what refers to waste management and occupational health and safety; and (ii) promptly notify the Bank of any related unexpected accident or incident during the construction of the Project;
(c) keep updated and available all relevant documents, such as documents supporting compliance with EU environmental directives, and any other information to be promptly provided to the Bank upon request (with reference to the commitment in the Bank’s public disclosure policy on responses to external enquiries);
(d) take into consideration the potential cross-border effects of any of the schemes proposed;
(e) ensure that, for projects requiring an Environmental and Social Impact Assessment Study, these are made available to the public;
(f) notify the Bank of any state-aid or EU funding related event arising in relation with the Project;
(g) not commit any EIB funds against schemes that require an Environmental and Social Impact Assessment Study and/or biodiversity assessment according to the applicable Directives and national law, without, prior to commitment, receiving the consent from the Competent Authority, and the Environmental and Social Impact Assessment Study having been made available to the public;
(h) ensure that there is no double-financing of the schemes with other EIB loans with the same Promoter;
(i) promptly inform the Bank when the implementation of any allocated scheme is suspended or the scheme is cancelled;
(j) ensure that the tender dossiers for all contracts to be financed by the Bank shall include an effective national mechanism for the remedy of complaints;
(k) promptly inform the Bank of any changes to the initial procurement plan(s);
(l) consult with the Bank prior to entering into any material amendments to works or services contracts financed by the Loan in order to verify the alignment with the provisions under the Technical Description;
(m) ensure that the design of the project components shall include value engineering for reducing the cost where possible without significantly affecting the performance of the project;

Additional Undertakings. The Borrower, directly or by means of the Promoter, shall:
(i) promptly inform the Bank of any changes to the initial procurement plan;
(ii) communicate updated Project procurement and implementation plans to the satisfaction of the Bank on a six monthly basis;
(iii) at the request of the Bank, provide an updated forecast of expenditures for the whole duration of the Project;
(iv) at the request of the Bank, provide the results of the technical and financial audit of the Project realised by an independent auditor;
(v) to the satisfaction of the Bank, adequately run the Technical Assistance until the Project completion;
(vi) at the request of the Bank, provide the deliverables of the Technical Assistance on teacher training as defined in the terms of reference for the relevant technical assistance to the Bank;
(vii) use of the available tools (such as the SELFIE tool of the European Commission) to help schools assess where they stand with digital learning;
(viii) ensure that the schools and regions have sufficient technical capabilities to maintain the provided IT equipment;
(ix) keep the Bank informed about any policy changes that may jeopardise the objectives of the Project, including major changes in curricula, organization of the school year, streaming and the promotion of pedagogical practices;
(x) ensure that the schools are staffed with the required teachers, technical and administrative personnel who will have been adequately trained;
(xi) timely inform the Bank if and when any change or event that may impact the implementation of a sub-project;
(xii) ensure that a school is equipped with a WLAN system only if a broadband connection on location is suitable for conduction of classes using digital means in all classes in one shift (active classrooms). For this purpose, a suitable connection means: for schools with 10 or more classes not less than 30Mbps download and 5Mbps upload and for schools with less than 10 classes not less than 20Mbps download and 2Mbps upload. In addition, Borrower shall ensure that on the long term bases and not later than 2025 each school with WIFI is equipped with not less than 30/30Mbps broadband connection;
(xiii) ensure that the computers provided for IT classrooms will be connected to the network;
(xiv) ensure to the satisfaction of the Bank that all the project components are managed and monitored by using state of the art ICT (Information and Communication Technology) based practices comparable to the currently used pl...
Additional Undertakings. The Borrower, directly or by means of the Promoter, shall:
(i) ensure that the Promoter implements the Project in accordance with the respective resettlement policy framework ("RPF") and environmental management framework (EMF);
(ii) ensure that upon signature of each work or service contract relating to the Project, in line with the most recent edition of the Bank’s Guide to Procurement, as published on its website, promptly submit to the Bank copies of the relevant contract and the signed covenant of integrity;
(iii) ensure that the actions are taken to achieve the Project indicators as specified below: Perform road safety audits at all relevant stages 100% of project roads Road safety impact assessments inputs provided for road sections covered by the New Project Implementation Contracts 90% 100% Provide decisions on recommendations made from road safety audits on road sections covered by the New Project Implementation Contracts 50% 100% Conduct safety ratings surveys on road sections covered by the New Project Implementation Contracts 100%
(iv) ensure that, for Ongoing Project Implementation Contract(s), the recommendations of independent Road Safety Audits (RSA) have been included in the final design and will be checked at completion/during early operation, as appropriate, documented with RSA Summary Tables listing all identified problems, proposed recommendations, and decisions made by the responsible authority;
(v) ensure that, for New Project Implementation Contract(s) a Road Safety Impact Assessment (RSIA) is prepared, confirming that the improvements will result in an expected net reduction in road fatalities and serious injuries;
(vi) ensure that, for New Project Implementation Contract(s) Road Safety Audits (RSA) are carried out on the final design, documented with RSA \ Feedback Form Tables listing all identified problems, proposed recommendations, and decisions made by the responsible authority; and
(vii) ensure that, for New Project Implementation Contract(s) an assessment of the Safety Ratings on the final design for all relevant road users, including non-motorised road users, based on the EU methodology for network wide road safety assessment, or similar methodology, is prepared.
Additional Undertakings. The Borrower (acting through the MoME) shall, and shall ensure that the Promoter shall:
(a) ensure that individual allocations comply with the eligibility criteria and the reporting requirements as defined in this Contract;
Additional Undertakings. The Borrower, directly or by means of the Promoter, shall:
(i) promptly inform the Bank of any changes occurring with regards to the Project Implementation Unit;
(ii) maintain an adequately staffed Project Implementation Unit until project completion to the satisfaction of the Bank;
(iii) ensure that the review procedures for remedies, as provided in Serbian law, shall be available to any party having had an interest in obtaining a particular contract and who has been or risks being harmed by an alleged infringement. The remedy mechanism procedures have to be included in all tender dossiers;
(iv) implement the project in accordance with the Resettlement Policy Framework, Environmental and Social Management Plan, Resettlement Action Plan and Stakeholder Engagement Plan;
(v) undertake third party evaluation of the implementation of the Resettlement Action Plan within six months of its completion;
(vi) within six months prior to commissioning the Project, submit an operation and maintenance plan for the project, satisfactory to the Bank, and then continue to implement such plan for the life of the Loan.
Additional Undertakings. The Borrower, directly or by means of the Promoter, shall:
(i) promptly inform the Bank of any changes occurring with regards to the Project Implementation Unit;
(ii) maintain an adequately staffed Project Implementation Unit until project completion with proper experience in procurement as well as preparing and reviewing of design, cost analysis benefit, feasibility and environmental and social impact assessment studies in water sector projects, supported by suitably experienced consultants, to the satisfaction of the Bank;
(iii) allocate the funds to the eligible schemes with procedures modulated according to the scheme size and in line with applicable loan procedures as indicated in Schedule F;
(iv) ensure that the Promoter verifies the compliance of the schemes with the relevant and applicable public procurement procedures;
(v) ensure that there is no double-financing of the schemes with other IFI loans with the same borrower;
(vi) promptly inform the Bank when the implementation of any allocated scheme is suspended or the scheme is cancelled;
(vii) ensure that the review procedures for remedies, as provided in Serbian law, shall be available to any party having had an interest in obtaining a particular contract and who has been or risks being harmed by an alleged infringement. The remedy mechanism procedures have to be included in all tender dossiers;
(viii) submit the detailed procurement plan before each allocation and will promptly inform the Bank of any changes to the initial procurement plan(s);
(ix) consult with the Bank regarding the amendment of the contracts financed by the Bank and shall seek the Banks non-objection prior to entering into any material amendments to contracts financed by the Bank;
(x) ensure that the municipal public water utility companies will move towards full O&M cost-recovery tariffs, as envisaged by the National Water Management Strategy. Until that objective has been achieved, the Borrower shall ensure that the municipalities receiving financing will commit themselves to finance any deficit between the full cost of operation & maintenance and tariff revenues;
(xi) not commit any EIB funds against schemes that require an EIA or biodiversity assessment according to national law and EU EIA related Directives without, prior to commitment, receiving the consent from the competent authority, and the Non-Technical Summary of the EIA and the EIA having been made available to the public, for publication on the Bank’s website, a...
Additional Undertakings. The Borrower, directly or by means of the Promoter, shall:
(a) promptly inform the Bank of any changes occurring with regards to the Project Implementation Unit;
(i) ensure that adequate environmental and social management plans, defined according to the legal requirements and related documents, are implemented and monitored during the construction of the different schemes, namely in what refers to waste management and occupational health and safety; and (ii) promptly notify the Bank of any related unexpected accident or incident during the construction of the Project;
(c) keep updated and available all relevant documents, such as documents supporting compliance with EU environmental directives, and any other information to be promptly provided to the Bank upon request (with reference to the commitment in the Bank’s public disclosure policy on responses to external enquiries);
Additional Undertakings. The Borrower, directly or by means of the Promoter or the Beneficiaries, shall:
(a) Provide evidence in form of a letter listing the legally binding agreement/s to construct the interconnector in Republic of Serbia and Bulgaria;
(b) send to the Bank the minutes of the regular Working group meetings on Project management (as defined in the MoU signed by the energy ministers on behalf of the two governments) or any other similar Project coordination meetings between the entities involved in the implementation of the interconnector in Republic of Serbia and Bulgaria;
(c) ensure that the construction contractor will prepare comprehensive reinstatement and biodiversity monitoring plans, which identify detailed actions for the bio-restoration of non-critical and critical habitats. This includes specific reinstatement and restoration goals and monitoring parameters for each habitat. The implementation of the monitoring plans should be controlled by the Promoter or the Beneficiaries;
(d) ensure that the mitigation measures outlined in the EIA Report, in the environmental and construction permits as well as in the E&S management plan (ESMP) will be fulfilled and complied with in all respects as per conditions. The compliance with those requirements should be confirmed in both the Project Progress Reports and the Project Completion Report according to the reporting criteria defined in finance contract;
(e) ensure that the contractor constructs the Project in accordance with health and safety legislation, applicable standards and design codes. The health and safety measures implemented on construction sites should be in line with Serbian requirements, international good practice and EIB Standards.
