CLAIMS索赔. 16.1 In case the Commodities are not in conformity with this Contract or the Seller is in breach of other provisions herein, the Seller shall settle the claim lodged by the Buyer and/or the Enduser by one or a combination of the following ways with the agreement of the Buyer and/or the Enduser: 如果货物不符合本合同规定或卖方违反其他条款，卖方应经买方和/或最终用户同意后按照下列一种或多种方式处理买方和/或最终用户索赔: 16.1.1 In case of return of the Commodities by the Buyer and/or the Enduser, the Seller shall refund to the Buyer the Contract Value of the Commodities rejected in the same currency as specified in the Contract and bears all direct losses and expenses incurred including but not limited to interest, accrued banking charges, freight and insurance premium, inspection changes, storage, stevedore charges and other necessary expenses required for the custody and protection of the rejected Commodities; and/or 买方和/或最终用户退货，卖方将退款金额以合同规定的成交货币支付给买方，并承担因退货而发生的一切损失及费用，包括但不局限于利息、银行费用、运费、保险费、商检费、仓储费、装卸费以及为保管退货而发生的一切其他必要费用；和/或 16.1.2 Reduce the Contract Value of the Commodities according to the degree of inferiority, extent of damage and amount of losses suffered by the Buyer and/or the Enduser, as agreed between the Parties; and/or 各方可按照货物的疵劣程度、损失的范围和买方和/或最终用户所遭受的损失，协议将货物降价处理；和/或 Replace the defective Commodities with new parts, components and/or equipment which conform to the specifications, quality and performance as specified in this Contract, and/or under the request of Buyer or Enduser to repair the defective Commodities at the Seller’s expenses and risks and bear all related expenses sustained by the Buyer and/or the Enduser. The Seller shall at the same time guarantee the quality of the replaced Commodities for a further corresponding period. 调换有瑕疵的货物，调换的货物必须是全新的并且符合本合同规定的规格、质量和性能；和/或依据买方或最终用户的要求修复有瑕疵的货物，卖方并负担由此而产生的一切费用和买方和/或最终用户所遭受的一切损失。对换货的质量，卖方仍应按照本合同规定，提供相同的质保期。
