Common use of Governing Law and Jurisdiction Clause in Contracts

Governing Law and Jurisdiction. a. The Services and these Terms and Conditions and the rights and obligations of each party under these Terms and Conditions shall be governed by and construed in accordance with the laws of the People’s Republic of China (“China”). b. Any dispute arising from the performance of these Terms and Conditions or in connection with them may be resolved by negotiation between the customer and the Bank. If it could not be resolved by negotiation, any party may take proceedings in the court of competent jurisdiction in the place where the Bank has its domicile. Each of the Bank and the Customer submits to the non-exclusive jurisdiction of the Courts of China but any of the Terms and Conditions other than those in dispute shall be enforced during the proceedings.
