STATUTORY HOLIDAYS. The following holidays shall be recognized as legal holi- days: New Year’s Day Labour Day Good Friday Thanksgiving Day Victoria Day Christmas Day Dominion Day Boxing Day Civic Day Employees hired after June will not be eligible for the Civic Day Statutory Holiday. Employees hired prior to June who are promoted to full time will maintain their entitlement the Civic Day Statutory Holiday. To qualify for pay fora legal holiday, the employee must work his last scheduled working day preceding the holiday and his first scheduled working day after the holiday unless he has secured permission his Store Owner or his designate to be on one of the qualifying days. Employees who are off on compensation, accident or illness shall receive legal holiday pay if they have within fifteen days of the holiday. They shall receive the difference between the legal holiday pay and what they otherwise receive from the Insurance Company Workers’ Compensation. Should legal holiday occur within an employee’s leave of absence, he shall not be paid for such legal holiday. An employee required to work on any of the aforementioned holidays shall receive two (2) his regular hourly rate for all hours worked. An hired after June required to work on any of the aforementioned holidays shall receive one and a half (I times his regular hourly rate for all hours worked. Employees hired prior to June who are promoted to full time will maintain their entitlement to overtime at the rate of (2) times their regular hourly rate. Work on any of the aforementioned holidays shall be volun- tary and no employee shall be coerced to work. Employees hired after June may be required to work on the Civic Holiday. Civic Holiday will continue to be voluntary for employees hired prior to June who are promot- ed to full time.

STATUTORY HOLIDAYS. In recognition that statutory holidays may be scheduled work days for shift workers, employees will be scheduled off for up to twelve (12) days in lieu of statutory holidays. These days off in lieu of statutory holidays shall normally be scheduled in the pay period in which the statutory holiday falls and, subject to departmental requirements, in conjunction with scheduled days off in that pay period. Department Managers, at their discretion, may permit the banking of some or all of such statutory holidays which will be taken off at a time mutually agreed upon by the employee and Supervisor.
