Failure to meet the standard(s) set forth in an Academic Performance Indicator is not a “material violation” as defined in XXXX 0000, §22-8B-12(K)(1). Rather it may be deemed a failure “to meet or make substantial progress toward achievement of the department’s minimum educational standards or student performance standards” (NMSA 1978, §22-8B-12(K)(2)) and may be assessed accordingly for purposes of nonrenewal or revocation.
