Common use of ACC Payments Clause in Contracts

ACC Payments. (a) All payments made to the Employee by the Employer in relation to work related accidents/injuries, whether relating to first week earnings related compensation or otherwise, shall be treated as advances of salary or wages. These advances shall be recoverable at the discretion of the Employer should the Employee’s claim for earnings related compensation be ultimately rejected or, with respect to the payment of the first week earnings related compensation, be determined by ACC to be a non-work injury.
