Acceptance of Concession. The Concessionaire hereby accepts the Concession and agrees and undertakes to implement the Project/ manage the Project Facility, and to perform/ discharge all of its obligations in accordance with the terms and conditions set forth in this Agreement. 3.1 Handover of the Project Site(s) & BQS Group (a) DTIDCL shall, handover to the Concessionaire physical possession of the constructed BQS Group(s) free from Encumbrances together with the necessary right of way for the sole purpose of implementing the Project in accordance with mutually agreed upon schedule. (b) The handing over of atleast 75% of total number of BQS as set out for Zone shall be completed within six (6) months from the Appointed Date. Provided, where a minimum 75% of BQS cannot be handed over to the Concessionaire, the Concessionaire shall have the right to abandon the project giving three (3) months notice to DTIDCL and in such case pro-rata payment upto the end of aforesaid three
