Common use of Access to Pro Rata Long Service Leave Clause in Contracts

Access to Pro Rata Long Service Leave. 8.7 (a) Subject to paragraph (b) of this subclause and subclause 8.8, employees within seven (7) years of their preservation age under Western Australian Government superannuation arrangements may, by agreement with their employer, choose to access pro rata long service leave at the rate of 9.28 days per completed 12 month period of continuous service.

Under this subclause, pro rata long service leave can only be taken as paid leave and there is no capacity for payment in lieu of leave. Employees may by agreement with their employer, clear any pro rata entitlement to long service leave in minimum periods of one (1) day.
