Additional Funding for Xxxxxx Avenue Improvements. Landowner shall pay the City one hundred thousand dollars ($100,000) no later than the date of issuance of the first building permit for the Project. The City shall use such funds to make or facilitate improvements to Xxxxxx Avenue between South Main Street and the driveway entrance to the Broadway Plaza Property that is across from Xxxxx Xxxx, provided the City approves and commences construction within ten (10) years; otherwise, there shall be no limitation on the City’s use of such funds. The improvements described in this Section 5.02 have not been even conceptually determined, and the City retains discretion to determine what improvements to pursue, if any, and the schedule for pursuing any such improvements, after conducting appropriate review under the California Environmental Quality Act. The City has not yet determined whether to approve or carry out any particular project, and it makes no commitment to do so.

  • BUY AMERICA REQUIREMENT (Applies only to Federally Funded Highway and Transit Projects) With respect to products purchased by Customer for use in federally funded highway projects, Contractor shall comply with all federal procurement laws and regulations with respect to such projects, including the Buy American provisions set forth in 23 U.S.C. Section 313, 23 C.F.R. Section 635.410, as amended, and the Steel and Iron Preference provisions of Texas Transportation Code Section 223.045, to the extent applicable. Contractor agrees to provide all certifications required by Customer regarding such programs.
