Common use of ADDITIONAL RESPONSIBILITIES OF PROVIDER Clause in Contracts

ADDITIONAL RESPONSIBILITIES OF PROVIDER. A. Provider is an independent contractor and is not an agent, servant, or employee of MPS. Provider’s engagement with MPS is limited solely to the operation of the Summer Recreation Program as outlined in this Agreement. Provider shall employ a sufficient number of qualified and properly-trained staff according to the contractually required minimum average daily attendance and DCF licensing standards. Any staff member that is not reasonably acceptable to MPS shall be removed by Provider from said staff member’s assignment to MPS’s Summer Recreation Program. MPS may request such removal at any time, in its sole discretion.
