Adequacy of Funding. The City and its financial advisors shall have approved and confirmed, pursuant to Sections 5 and 8(m), that OVG’s Project Budget and funding, including the amount of the Budgeted Equity and sources and uses of funds, is sufficient to cover the Project Cost, such approval not to be unreasonably withheld, conditioned, or delayed, provided that OVG shall arrange for the City and its financial advisors to have reasonable access to such information as might be reasonably required to make such confirmation.

Adequacy of Funding. 4 Finally, Xxxxxxx Objectors criticize the $1.1 billion settlement as amounting to less than 5 1% of Caltrans overall budget and argue that there is no assurance that $1.1 billion is sufficient 6 to rectify all of the access barriers. (Xxxxxxx Objections at 10.) This argument erroneously 7 assumes that the entirety of Caltrans budget is available to fund access improvements. The 8 vast majority of the Caltrans budget is allocated to operations, maintenance and local assistance 9 projects that cannot be applied to barrier removal. (Xxxxxxx Decl. ¶ 9.) According to 10 Defendants’ expert, the only budget specifically available to fund access projects is the SHOPP
Adequacy of Funding. Within funding constraints recognised under section 3(2) of the New Zealand Public Health and Disability Xxx 0000 (NZPHD Act), the Parties agree that any service agreements or Section 88 notices transferred to the DHB should be appropriately funded to allow the DHB to meet its transferring obligations.   • Contingency of Funding 6.26.1 A-E acknowledges that funding or portions of funding for this CONTRACT may also be contingent upon receipt of funds from, and/or appropriation of funds by, the State of California or other funding sources to COUNTY. If such funding and/or appropriations are not forthcoming, or otherwise limited, COUNTY may immediately terminate or modify this CONTRACT without penalty.

  • Reduction of Funding The Department must by law terminate this contract if funds are not appropriated or otherwise made available to support the Department's continuation of performance of this contract in a subsequent fiscal period. (18-4-313(4), MCA.) If state or federal government funds are not appropriated or otherwise made available through the Department budgeting process to support continued performance of this contract (whether at an initial contract payment level or any contract increases to that initial level) in subsequent fiscal periods, the Department shall terminate this contract as required by law. The Department shall provide Contractor the date the Department's termination shall take effect. The Department shall not be liable to Contractor for any payment that would have been payable had the contract not been terminated under this provision. As stated above, the Department shall be liable to Contractor only for the payment, or prorated portion of that payment, owed to Contractor up to the date the Department's termination takes effect. This is Contractor's sole remedy. The Department shall not be liable to Contractor for any other payments or damages arising from termination under this section, including but not limited to general, special, or consequential damages such as lost profits or revenues.

  • Lack of Funding The Parties recognize that the compensation provided for in this Grant Contract depends on budget approval and appropriations of sufficient grant funds by the Lancaster County Board of County Commissioners (“Grant Funds”). The Parties further recognize that the Sponsor may terminate this Grant Contract in whole or in part immediately upon written notice to Grantee if grant funds do not receive sufficient budget approval or appropriations. The date Project Monitor sends the written notice of termination shall be the date of termination. The Grantee understands and agrees that the Sponsor shall not provide for funding under this Grant Contract from the Lancaster County General Fund, tax revenue, or any other source, and that the sole source of funding for this Grant Contract shall be approved and appropriated Grant Funds. In the event that Grant Funds do not receive sufficient budget approval or appropriations, the Grantee shall be compensated pursuant to the terms of this Grant Contract for authorized Project Account costs charged against the Project Account prior to the date of termination according to the approved Project Budget. Xxxxxxx agrees that Xxxxxxx has no reasonable expectation of payment for unauthorized costs, or for payment of any kind from any other source. The Grantee further understands and agrees that any costs not covered by the current Grant Contract are not authorized.

  • Adjustment of Funding (a) The LHIN may adjust the Funding in any of the following circumstances:

  • Source of Funding DHS shall provide funding information to all subrecipient/contractors for audit purposes, including the name of the program, the federal agency where the program originated, the Assistance Listing (formerly CFDA) number and the percentages of federal, state and local funds constituting the agreement.

  • Sufficiency of Funds Buyer has sufficient cash on hand or other sources of immediately available funds to enable it to make payment of the Purchase Price and consummate the transactions contemplated by this Agreement.

  • Contingency of Funds Contractor acknowledges that funding or portions of funding for this Contract may be contingent upon state budget approval; receipt of funds from, and/or obligation of funds by, the state of California to County; and inclusion of sufficient funding for the services hereunder in the budget approved by County’s Board of Supervisors for each fiscal year covered by this Contract. If such approval, funding or appropriations are not forthcoming, or are otherwise limited, County may immediately terminate or modify this Contract without penalty.

  • Provision of Funding 3.1 In each Funding Year, the LHIN shall advise the HSP of the amount of its Estimated Provincial Subsidy. The amount of the Estimated Provincial Subsidy shall be calculated on both a monthly basis and an annual basis and will be allocated among the Envelopes and other funding streams applicable to the HSP, including the CFS.

  • Sources of Funding A. State funding for dual credit/concurrent courses will be available to both the ISD and Hill College based upon the current agreement between the Commissioner of Education and Commissioner of Higher Education. In accordance with this agreement, Hill College may claim state funding for all students registered for college-level credit in a dual credit/concurrent course. The ISD may also claim full ADA funding for all students registered in a dual credit/concurrent course.
