Adequate Price Competition. The KO has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the KO will review this determination and if, in the KO’s opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the KO determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the KO to determine the reasonableness of price IAW FAR 15.403-3. L-5.4.2 Cost or Pricing Information Requirements. IAW FAR 15.403-1(b) and 15.403-3(a), the Government does not require certified cost or pricing data, but does require data other than certified cost or pricing data to support cost reasonableness and realism. Provide information IAW FAR 15.403-5. If the KO determines that there is insufficient information available to determine cost reasonableness and realism after receipt of proposals, and none of the exceptions in FAR 15.403-1 apply, the offeror shall be required to submit certified cost or pricing data. The burden of proof for credibility of proposed costs/prices rests with the offeror. The Government expects to receive a written cost proposal for all Tabs listed below for all prime contractors and subcontractors, and Excel cost proposals for Tab 2 and Tab 3 for the prime contractors and subcontractors. The offerors are not required to duplicate the excel spreadsheets in the written cost proposal.

  • Non-Competition a. Executive acknowledges and recognizes the highly competitive nature of the businesses of the Company and its affiliates and accordingly agrees as follows:

In addition, during the Restricted Period, the Director shall not develop any property for use in the Company’s Business on behalf of any person or entity other than the Company, its subsidiaries and affiliates.

  • Competition By accepting this Contract, Contractor agrees that no collusion or other restraint of free competitive bidding, either directly or indirectly, has occurred in connection with this award by the Division of Purchases.

  • SELLER’S RADON DISCLOSURE Pursuant to the Montana Code Annotated §75-3-606, to the extent the property is habitable:

It is understood and agreed that, for the purposes of the foregoing provisions of this paragraph, (i) no business shall be deemed to be a business conducted by Employer or any group, division, affiliate or subsidiary of Employer unless 5% or more of Employer's consolidated gross sales or operating revenues is derived from, or 5% or more of Employer's consolidated assets are devoted to, such business; (ii) no business conducted by any entity by which Employee is employed or in which he is interested or with which he is connected or associated shall be deemed competitive with any business conducted by Employer or any group, division or subsidiary of Employer unless it is one from which 2% or more of its consolidated gross sales or operating revenues is derived, or to which 2% or more of its consolidated assets are devoted; and (iii) no business which is conducted by Employer at the Date of Termination and which subsequently is sold by Employer shall, after such sale, be deemed to be a Competitive Operation within the meaning of this paragraph. Ownership of not more than 5% of the voting stock of any publicly held corporation shall not constitute a violation of this paragraph.
