Adjustments to Service Rates using the All Urban Consumer Price Index (CPI). Beginning on January 1, 2005, and annually thereafter, Contractor may receive, subject to compliance with all provisions of this Agreement, an annual adjustment in the maximum service rates set forth in Exhibit B to this Agreement, based on inflating or deflating the then existing rates by a percentage equal to 70 percent of the “San Xxxx-San Francisco-Oakland All Urban Consumer Price Index”. Beginning on January 1, 2016, and annually thereafter, Contractor may receive, subject to compliance with all provisions of this Agreement, an annual adjustment in the maximum service rates set forth in Exhibit B to this Agreement, based on inflating or deflating the then existing rates by a percentage equal to 85 percent of the “San Francisco-San Xxxx- Oakland Consumer Price Index for All Urban Consumers, All Items”. Effective January 1, 2016, the CPI rate increase shall not exceed four percent in any year. Effective January 1, 2004 and on January first of each of the next two consecutive years, the commercial rates shall be increased 3.5% in addition to any other rate increase allowed by this agreement. The cumulative increase over these three years will be 10.5% which are in addition to any adjustments in the CPI as allowed in this Agreement. The revenue from this rate increase shall be applied to the cost of the mandatory commercial recycling program that will begin January 1, 2004. Commercial customers receiving recycling services from Allied Waste at the time this agreement is approved by the City of Pleasant Hill shall be exempt from this supplemental increase through 2006. The cost of the mandatory commercial recycling program will be reviewed as a part of the comprehensive rate review for 2007 and be addressed in the rate revisions approved by the City Council at that time. The City shall perform a rate review beginning in June, 2013 for rates to take effect on January 1, 2014. (Rates shall not change in calendar year 2013, and 2014 rates shall not reflect retroactive rate increases to cover the cost of the 2012 Amendment items 2-6 and 8* implemented in 2012 and 2013.) During the two (or more) intervening years, Contractor will use the CPI rate adjustment specified above. *These items 2-6 and 8 are taken from the May, 2012 Extension Assessment prepared by NewPoint Group.   • Venue Limitation for TIPS Sales Vendor agrees that if any "Venue" provision is included in any TIPS Sale Agreement/contract between Vendor and a TIPS Member, that clause must provide that the "Venue" for any litigation or alternative dispute resolution shall be in the state and county where the TIPS Member operates unless the TIPS Member expressly agrees otherwise. Any TIPS Sale Supplemental Agreement containing a “Venue” clause that conflicts with these terms is rendered void and unenforceable.

  • Additional Procedures Applicable to High Value Accounts 1. If a Preexisting Individual Account is a High Value Account as of December 31, 2013, the Reporting [FATCA Partner] Financial Institution must complete the enhanced review procedures described in paragraph D of this section with respect to such account by December 31, 2014. If based on this review, such account is identified as a U.S. Reportable Account, the Reporting [FATCA Partner] Financial Institution must report the required information about such account with respect to 2013 and 2014 in the first report on the Account. For all subsequent years, information about the account should be reported on an annual basis.

  • Minimum Site Requirements for TIPS Sales (when applicable to TIPS Sale). Cleanup: When performing work on site at a TIPS Member’s property, Vendor shall clean up and remove all debris and rubbish resulting from their work as required or directed by the TIPS Member or as agreed by the parties. Upon completion of work, the premises shall be left in good repair and an orderly, neat, clean and unobstructed condition. Preparation: Vendor shall not begin a project for which a TIPS Member has not prepared the site, unless Vendor does the preparation work at no cost, or until TIPS Member includes the cost of site preparation in the TIPS Sale Site preparation includes, but is not limited to: moving furniture, installing wiring for networks or power, and similar pre‐installation requirements. Registered Sex Offender Restrictions: For work to be performed at schools, Vendor agrees that no employee of Vendor or a subcontractor who has been adjudicated to be a registered sex offender will perform work at any time when students are, or reasonably expected to be, present unless otherwise agreed by the TIPS Member. Vendor agrees that a violation of this condition shall be considered a material breach and may result in the cancellation of the TIPS Sale at the TIPS Member’s discretion. Vendor must identify any additional costs associated with compliance of this term. If no costs are specified, compliance with this term will be provided at no additional charge. Safety Measures: Vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage. Smoking: Persons working under Agreement shall adhere to the TIPS Member’s or local smoking statutes, codes, ordinances, and policies.

  • Adjustments to Security The Security provided by Interconnection Customer at or before execution of the Interconnection Service Agreement (a) shall be reduced as portions of the work are completed, and/or (b) shall be increased or decreased as required to reflect adjustments to Interconnection Customer’s cost responsibility, as determined in accordance with Section 217, to correspond with changes in the Scope of Work developed in accordance with Transmission Provider’s scope change process for interconnection projects set forth in the PJM Manuals.

  • Determination of One-Month LIBOR Pursuant to the terms of the Global Agency Agreement, the Global Agent shall calculate the Class Coupons for the applicable Classes of Notes (including MAC Notes on which the Exchange Administrator has directed the Global Agent to make payments) for each Accrual Period (after the first Accrual Period) on the applicable LIBOR Adjustment Date. “One-Month LIBOR” will be determined by using the “Interest Settlement Rate” for U.S. dollar deposits with a maturity of one month set by ICE Benchmark Administration Limited (“ICE”) as of 11:00 a.m. (London time) on the LIBOR Adjustment Date (the “ICE Method”). ICE’s Interest Settlement Rates are currently displayed on Bloomberg L.P.’s page “BBAM.” That page, or any other page that may replace page BBAM on that service or any other service that ICE nominates as the information vendor to display the ICE’s Interest Settlement Rates for deposits in U.S. dollars, is a “Designated Page.” ICE’s Interest Settlement Rates currently are rounded to five decimal places. If ICE’s Interest Settlement Rate does not appear on the Designated Page as of 11:00 a.m. (London time) on a LIBOR Adjustment Date, or if the Designated Page is not then available, One-Month LIBOR for that date will be the most recently published Interest Settlement Rate. If ICE no longer sets an Interest Settlement Rate, Freddie Mac will designate an alternative index that has performed, or that Freddie Mac (or its agent) expects to perform, in a manner substantially similar to ICE’s Interest Settlement Rate.
