ADMINISTRATION OF THE CONSTRUCTION CONTRACT. 11.01 The Designer will exercise care and endeavor to require the Contractor to strictly adhere to the plans and specifications, to guard the Owner against defects and deficiencies in the work of Contractors, and based upon its on-site observations and inspections shall promptly notify the Owner in writing of any significant departure in the quality of materials or workmanship from the requirement of the plans and specifications, but he does not guarantee the performance of the construction contracts. 11.02 The Designer’s actions shall be taken with such reasonable promptness as to cause no delay in the Work or in the activities of the Owner, Contractor or separate contractors, while allowing sufficient time in the Designer’s professional judgment to permit adequate review.
