Affidavit of Commencement. If requested by Lender, within thirty (30) days after the date of commencement of construction of the Improvements, Borrower shall execute and record in the appropriate records of Bexar County, Texas, an affidavit of commencement in proper form and in accordance with Texas Property Code Section 53.124, setting forth the date work actually commenced on the Improvements.
Affidavit of Commencement. Within ten (10) days after the commencement of construction of the Improvements, but not before construction of the Improvements has actually begun, Borrower shall file or cause to be filed in the appropriate records of the county in which the Land is situated, an Affidavit of Commencement in the form of Exhibit C attached hereto (the “Affidavit of Commencement”) and incorporated herein by this reference, duly executed by Borrower and Contractor. The date set forth in the Affidavit of Commencement for commencement of work under the Construction Contract shall not be on or before the date on which the Deed of Trust is recorded.

If requested by Lender in connection with any Home, Borrower will record an affidavit of commencement (“Affidavit of Commencement”) in the appropriate records of the county where the Home is located, in a form reasonably acceptable to Lender. Affidavit of Commencement. An Affidavit of Commencement, duly executed and acknowledged by all necessary parties. Lender and Borrower shall jointly complete any blank spaces in the Affidavit of Commencement, and shall jointly authorize its recordation, within one Business Day after confirmation of recordation of the Security Instrument.

Within ten (10) days after the applicable Commencement Date as to any House, and not before construction of such House has actually begun, file or cause to be filed in the appropriate records of the county in which the Lot is situated, an Affidavit of Commencement duly executed by Borrower and the contractor performing the work on such Lot.
Affidavit of Commencement. Upon request by Lender, Borrower, within ten (10) days after the Commencement Date for each House, or the A&D Commencement Date for each A&D Project, but not SECOND AMENDED AND RESTATED LOAN AGREEMENT - Page 27 before construction of the House, or A&D Improvements, has actually begun, shall file in the appropriate records of the county in which the Lot or A&D Project is situated, an affidavit (“Affidavit of Commencement”), in form and substance acceptable to Lender, duly executed and notarized by Borrower and Contractor. The date of commencement of work set forth in such Affidavit of Commencement shall not be the date of or prior to the date on which the applicable Security Instrument was recorded.
Affidavit of Commencement. If required or permitted by applicable Law, the Borrower shall file, on or before the deadline therefor as established by applicable Law, an affidavit or certificate (“Affidavit of Commencement”) of commencement of construction of the Improvements, duly executed by the Borrower, the General Contractor and/or any other Person required by applicable Law, in the appropriate records of the county in which the Land is situated. A copy of same shall be furnished to the Administrative Agent. Borrower shall have recorded the executed Affidavit of Commencement.
