Common use of Agency/Department Head Clause in Contracts

Agency/Department Head. If an employee has a problem relating to an interpretation or application of this Memorandum of Understanding, the employee may formally submit a grievance to the Agency/Department Head within fourteen (14) calendar days from the occurrence which gives rise to the problem. Such submission shall be in writing and shall state the nature of the grievance and the suggested solution. Within seven (7) calendar days after receipt of the written grievance, the Agency/Department Head or his or her designee shall meet with the grievant. Within fourteen (14) calendar days thereafter, a written decision shall be given to the grievant. In the case of a grievance appeal concerning a written reprimand, the decision of the Agency/Department Head shall be final and binding and shall not be subject to further processing under the MOU.
