Common use of Agreement Application Clause in Contracts

Agreement Application. This Agreement shall be the only plan, agreement or arrangement with respect to which benefits may be provided to Executive upon a termination of employment and supersedes all prior agreements, arrangements or related communications of the Company relating to separation benefits or accelerated vesting benefits for Executive, whether formal or informal, or written or unwritten. Subject to the foregoing, any benefits under this Agreement will be provided to Executive in lieu of benefits under any other separation plan or agreement (including any employment agreement or offer letter, and the Company’s Executive Change in Control and Severance Plan).
