Agreement Prevailing. Customers and/or Users may (i) download a mobile application, which is connected to and/or part of the Cloud ^ĞƌǀŝĐĞ ĂŶĚ ďLJ ĚŽŝŶŐ ƚŚŝƐ ĂĐĐĞƉƚ ƚĞƌŵƐ Ž-ƵĨƉ ƵƚƐĂĞď ͟Ĩ ŽĂƌƚo f ƐthƚeƵCŚĐloĞuŚd ǁŵĞŽďƐŝŝůƚ Services to obtain their respective Siemens ID, and by doing this notice terms of use on the site and accept terms and conditions posted on this Siemens ID site and/or (iii) accept terms of use in connection with a payment service to process an Order for the Cloud Services. In case any of these terms of use and/or terms and conditions are inconsistent with the terms and conditions of the Agreement, the Agreement shall prevail between Customer and Siemens.

  • NEGOTIATION PROCEDURES A. It is contemplated that matters included in this Agreement and other areas of common concern to the parties shall be subject to negotiation by mutual agreement between them from time to time during the period of this Agreement. The parties undertake to cooperate in arranging meetings, selecting representatives for such discussions, furnishing necessary information, and otherwise constructively considering the resolving of any such matters.

  • Agreement Terms The terms of the Agreement conform to University policy. The period of performance for the project is approximately one (1) year. The amount of funding support will not exceed $200,000. Since research projects are often amended, this agreement includes provisions for changes in time and scope. University procedures for approval of these changes will be followed and additional conflict of interest review will be done as appropriate.
