Common use of Agreements Surviving Termination Clause in Contracts

Agreements Surviving Termination. Employee acknowledges that, during his/her employment, s/he entered into a Nondisclosure and Development Agreement (“Nondisclosure Agreement”). Employee acknowledges and agrees that s/he will continue to be bound by the terms of the Nondisclosure Agreement. In addition, any other agreements that Employee may have signed with Millennial during his/her employment that survive his/her termination or that contain certain provisions surviving termination remain in effect. However, to the extent any terms of those agreements are contrary to or inconsistent with any terms of this Agreement, the terms of this Agreement control.

However, to the extent any terms of those agreements are contrary to or inconsistent with any terms of this Agreement or the Nondisclosure Agreement, the terms of this Agreement and the Nondisclosure Agreement shall control.
