Alluvial Xxxxx and Augmentation Sample Clauses

Alluvial Xxxxx and Augmentation. The City Enterprise agrees to use good faith efforts to maintain the City’s Alluvial Xxxxx and the connected well water storage tank in functionally operational condition capable of physically delivering water to Tri-State at rates up to 4.12 cfs and ensure the City’s Alluvial Xxxxx remain included in a decreed augmentation plan or approved substitute water supply plan to allow for uninterrupted out-of-priority pumping as necessary. The City Enterprise shall be responsible for replacing any out-of-priority depletions and post-pumping depletions resulting from operation of the City’s Alluvial Xxxxx under this Section 4, inclusive of subsections, pursuant to an augmentation plan decreed in Water Court or an approved Substitute Water Supply Plan.
