Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his consent. If an employee is transferred to a position outside of the bargaining unit, he shall retain his seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. If such an employee returns to the bargaining unit within twelve (12) months, he shall be placed in a job consistent with his seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.

If an employee is transferred to employment which is outside the bargaining unit, or is appointed to act temporarily for a period of greater than three (3) months in a position which is outside the bargaining unit, the employee shall retain accrued seniority rights for a period of six (6) months commencing from the day on which the transfer, promotion or acting appointment becomes effective. During the period of transfer, promotion or acting appointment outside of the bargaining unit an employee shall not accrue seniority, nor shall the employee be entitled to grieve under Article 8 of this Agreement. After the six (6) month period has expired, such an employee shall lose all seniority rights in the bargaining unit. If such an employee is transferred or promoted back to employment coming within the bargaining unit or ceases to act in a position outside the bargaining unit within the six (6) month period, the employee shall retain all accrued seniority in the bargaining unit and will again commence accruing seniority from the effective date of the employees return to a bargaining unit position.

If the position to which the employee is transferred is for a fixed term, the employee shall have the right to return to their former position at the completion of the term, providing the term does not exceed one (1) year. In the case of a parental leave coverage, the parties agree this right will be extended to allow for full coverage of the term.

An employee who is transferred with her consent to a position outside the bargaining unit shall retain her accumulated seniority for three (3) months from the date of leaving her unit, but will not accumulate any further seniority. If the employee returns to the bargaining unit within three (3) months, she shall be placed in a job consistent with her classification. Such return shall not result in the lay-off or bumping of an employee holding greater seniority or being placed on probation.

For the ninety (90) day period referred to above, the employee shall have recourse to the grievance procedure under the collective agreement with respect to disciplinary matters and shall pay union dues in accordance with Article 7. Notwithstanding the above, an employee who transfers shall retain her/his seniority in this bargaining unit up to the date of leaving the unit to a maximum of twelve (12) consecutive months, as long as the employee remains a member of another CUPE bargaining unit of the Employer.
