Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his consent. If an employee is transferred to a position outside of the bargaining unit, he shall retain his seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. If such an employee returns to the bargaining unit within twelve (12) months, he shall be placed in a job consistent with his seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.

If such an employee is transferred or promoted back to employment coming within the bargaining unit or ceases to act in a position outside the bargaining unit within the six (6) month period, the employee shall retain all accrued seniority in the bargaining unit and will again commence accruing seniority from the effective date of the employees return to a bargaining unit position.

Ifthe position to which the employee is transferred is permanent, they shall only have the right to return to their former position in the bargaining unit during the trial period in the position. Ifthe position to which the employee is transferred is for a fixed term, the employee shall have the right to return to their former position at the completion ofthe term, providing the term does not exceed one (1) year. In the case of a parental leave coverage, the parties agree this right will be extended to allow for full coverage of the term.

For the ninety (90) day period referred to above, the employee shall have recourse to the grievance procedure under the collective agreement with respect to disciplinary matters and shall pay union dues in accordance with Article 7. Notwithstanding the above, an employee who transfers shall retain her/his seniority in this bargaining unit up to the date of leaving the unit to a maximum of twelve (12) consecutive months, as long as the employee remains a member of another CUPE bargaining unit of the Employer.
