Common use of Alterations to Train Services Clause in Contracts

Alterations to Train Services. (a) If the Operator does not propose to operate a Train Service the Operator must, prior to the scheduled operation of the Train Service, advise Aurizon Network of the cancellation of such Train Service the reason for such cancellation and specify the End User for that Train Service. (b) In the event that a Train Service is unable to operate in accordance with its Scheduled Time then, provided that the Operator has complied with Clause 6.2(a), Aurizon Network will use its reasonable endeavours to provide an alternative Scheduled Time for the relevant Train Service provided that: (i) Aurizon Network will be under no obligation to alter the scheduled times for other Train Movements; and (ii) Aurizon Network has no obligation to the Operator to provide an alternative Scheduled Time where the End User has nominated another Accredited Railway Operator to operate the relevant Train Service. (c) In the event that for any reason the Operator does not operate a Train Service at its Scheduled Time in the Train Schedule or at any other Scheduled Time advised by Aurizon Network in accordance with Clause 6.3(b), Aurizon Network may authorise the operation of another Train Movement at that Scheduled Time. (d) In the event that a Train Service is for any reason unable to commence to operate in accordance with its Scheduled Time and following bona fide consultation between the Parties it is not possible for Aurizon Network to provide an alternative Scheduled Time reasonably acceptable to both Parties, such Train Service may be cancelled by either Party giving notice to the other Party as soon as practicable.

Deleted: 5.2(a) (b) In the event that a Train Service is unable to operate in accordance with its Scheduled Time then, provided that the Operator has complied with Clause 6.2(a5.2(a), Aurizon Network Queensland Rail (a) will use its reasonable endeavours to provide an alternative Scheduled Time for the relevant Train Service provided that: (i) Aurizon Network Queensland Rail will be under no obligation to alter the scheduled times for other Train Movements; and (ii) Aurizon Network Queensland Rail has no obligation to the Operator to provide an alternative Scheduled Time where the End User has nominated another Accredited Railway Operator to operate the relevant Train Service.. Deleted: 5.3(b) (c) In the event that for any reason the Operator does not operate a Train Service at its Scheduled Time in the Train Schedule or at any other Scheduled Time advised by Aurizon Network Queensland Rail in accordance with Clause 6.3(b5.3(b), Aurizon Network Queensland Rail may authorise the operation of another Train Movement at that Scheduled Time. (d) In the event that a Train Service is for any reason unable to commence to operate in accordance with its Scheduled Time and following bona fide consultation between the Parties it is not possible for Aurizon Network Queensland Rail to provide an alternative Scheduled Time reasonably acceptable to both Parties, such Train Service may be cancelled by either Party giving notice to the other Party as soon as practicable.
