Common use of Amelioration of Penalty Clause in Contracts

Amelioration of Penalty. Where an employee has been subject to suspension, dismissal, discharge or any other penalty for any alleged act or omission and the Board of Arbitration determines that such suspension, dismissal, discharge or penalty is unjust, or contrary to the terms of this Agreement, the Board of Arbitration shall have the power to rescind or vary any such penalty including reinstatement without loss of seniority or other benefits whatsoever and has the further power to request that such employee be compensated for all time lost.
