Common use of Amendment of the Permit Clause in Contracts

Amendment of the Permit. ‌ The Permit may be amended to accommodate changed circumstances in accordance with all applicable legal requirements, including but not limited to the ESA, the National Environmental Policy Act, the Service’s permit regulations at 50 CFR 13 and 17, and the State of Nevada’s regulations at NRS 503. Any Party may propose amendments to the Permit by providing written notice to the other Party. Such notice shall include a statement of the proposed amendment, the reason for it, and its expected results. The Parties will make their best efforts to respond to proposed amendments within 90 calendar days of receiving the notice. Proposed amendments will become effective upon fulfillment of the legal requirements stated above. Any amendments to the Agreement will not affect Cooperators’ responsibilities under existing Cooperative Agreements.
