Applicability of HIPAA. The Customer understands and agrees that it must separately enter into and execute a Business Associate Agreement (“BAA”) if (1) Customer qualifies as a Covered Entity or Business Associate and (2) Customer will make Protected Health Information available to Aircall in connection with performing the Agreement, to the extent such Protected Health Information is collected from patients in the United States and its territories and possessions.

Applicability of HIPAA. The use of terms defined by the HIPAA Rules throughout this agreement, including use of the term Business Associate will not be construed as an admission that Intronis or Reseller is subject to the HIPAA Rules with regard to any specific information. Consistent with Paragraph 2 above, the parties agree the obligations and responsibilities set forth in this agreement are only applicable with respect to information that is received, maintained or created by Intronis on behalf of a Covered Entity or a Business Associate as defined by the HIPAA Rules and is PHI or EPHI as defined by the HIPAA Rules.
Applicability of HIPAA. Data may contain PHI. Further, some, but not all, Members may be a Covered Entity or a Business Associate. To support the privacy, confidentiality, and security of Data, each Member agrees as follows: a. If Member is a Covered Entity, the Member shall at all times comply with HIPAA, as applicable. b. If Member is a Business Associate, Member shall at all times comply with the all applicable provisions of HIPAA, its Business Associate Agreements (or for governmental entities relying upon 45 C.F.R. §164.504(e)(3)(i)(A), its Memoranda of Understanding), and Applicable Law. c. If Member is a Governmental Member, Member shall at all times comply with the applicable privacy and security laws and regulations. d. If Member is neither a Covered Entity, Business Associate nor a Governmental Member, Member shall, as a contractual standard, at all times, at a minimum, comply with: (i) provisions of HIPAA as required by the Network Operating Policies and Procedures, and (ii) as applicable, the Network Business Associate Agreement.
Applicability of HIPAA. If You are a “Covered Entity” as defined under HIPAA, You and Riverside agree that the Business Associate Addendum will govern HIPAA-related matters (click here to review the Business Associate Addendum). If You are not a Covered Entity, this Section does not apply.
Applicability of HIPAA. The HIE Content exchanged through the HIE in accordance with this Agreement is expected to contain PHI. HIPAA therefore applies as follows: (i) If Participant is a Covered Entity, Simply Connect is a Business Associate of Participant, to the extent Simply Connect is receiving, using or disclosing PHI on behalf of Participant or as part of services provided to Participant. (ii) If Participant is a Business Associate, Simply Connect is a Subcontractor which is a Business Associate of Participant, to the extent Simply Connect is receiving, using or disclosing PHI on behalf of Participant or as part of services provided to Participant. (iii) Participant shall not become a Business Associate or Subcontractor of any other Participant by virtue of signing this Agreement or by exchanging HIE Content with any other Participant unless Participant engages in such exchange on behalf of the other Participant or for purposes of services it is providing to the other Participant. As between Participant and Simply Connect, Participant shall be solely responsible for ensuring that it has entered into any Business Associate Agreement required for purposes of its exchange of HIE Content with any other Participant. (iv) To support the privacy, confidentiality, and security of the HIE Content and the HIE, Participant shall at all times comply with HIPAA.
