Common use of Apprenticeship Plan and Program Clause in Contracts

Apprenticeship Plan and Program. (a) No later than six months after Financial Close, Project Co shall provide a plan setting out Project Co’s Project-specific approach to maximizing apprenticeship opportunities on the Project (the “Apprenticeship Plan”) for review and approval by the College. The Apprenticeship Plan shall include, (i) specific objectives for apprenticeship opportunities for the Project on a trade-by- trade basis; (ii) apprenticeship opportunities for each trade required on the Project; (iii) a confirmation that apprenticeships will be registered with the Ministry of Training, Colleges and Universities and the Ontario College of Trades, as applicable; (iv) a program to ensure the required supply of apprentices to meet Project Co’s Apprenticeship Plan targets and requirements; (v) a program to support apprentices on the Project, to complete their apprenticeships during the Project Term and, for those whose apprenticeships are not complete by the end of the Project Term a program to support apprentices to complete their apprenticeships after the end of the Project Term; and (vi) a focused program for youth-at-risk, local communities, and military veterans. (b) Project Co shall implement the approved Apprenticeship Plan. (c) Project Co shall provide an annual report to the College on the implementation of the Apprenticeship Plan which report shall include, (i) statistics on the number of apprentices involved in the Project relative to the number of journeypersons, for each month of the Project; and (ii) detailed information setting out Project Co’s progress toward achieving the objectives set out in the Apprenticeship Plan, including an identification of an barriers that prevented Project Co from achieving its objectives. (d) The College may require Project Co to amend its Apprenticeship Plan if, in its opinion, acting reasonably, Project Co is failing to maximize apprenticeship opportunities on the Project pursuant to the then current Apprenticeship Plan. (e) The College may, in its sole discretion, release Project Co’s Apprenticeship Plan to the public. Project Co’s Apprenticeship Plan shall not be Confidential Information.

The Apprenticeship Plan shall include, (i) specific objectives and methods for training and apprenticeship opportunities for the Project on a trade-by- by-trade basis; (ii) apprenticeship opportunities for each trade required on the Project; (iii) the number of apprentices to be employed for the Works, shall be in accordance with journeyperson to apprentice ratios established in section 60 of the Ontario College of Trades and Apprenticeships Act, 2009, S.O. 2009, c. 22, as amended from time to time; (iv) a confirmation that apprenticeships will be registered with the Ministry of Training, Colleges and Universities and the Ontario College of Trades, as applicable; (ivv) a program to ensure the required supply of apprentices to meet Project Co’s Apprenticeship Plan targets and requirements; (vvi) a program to support apprentices on the Project, to complete their apprenticeships during the Project Term prior to Substantial Completion and, for those whose apprenticeships are not complete by the end of the Project Term Substantial Completion Date a program to support apprentices apprentices, on a commercially reasonable basis, to complete their apprenticeships after the end of the Project TermSubstantial Completion Date; and (vivii) a focused apprenticeship program for youth-at-riskrisk youth, local communitieshistorically disadvantaged groups including low-income, racialized and immigrant populations, women, aboriginal persons, newcomers to Ontario, veterans, persons with disabilities, and military veteransresidents of the community(ies) in which the Project is located. (b) Project Co shall implement the approved Apprenticeship Plan. (c) Project Co shall provide an annual report to the College Contracting Authority on the implementation of the Apprenticeship Plan which report shall include, (i) statistics on the number of apprentices involved in the Project relative to the number of journeypersons, for each month of the Project; and (ii) detailed information setting out Project Co’s progress toward achieving the objectives set out in the Apprenticeship Plan, including an identification of an barriers that prevented Project Co from achieving its objectives. (d) The College Contracting Authority may require Project Co to amend its Apprenticeship Plan if, in its opinion, acting reasonably, Project Co is failing to maximize apprenticeship opportunities on the Project pursuant to the then current Apprenticeship Plan. (e) The College Contracting Authority may, in its sole discretion, release Project Co’s Apprenticeship Plan to the public. Project Co’s Apprenticeship Plan shall not be Confidential Information.

(c) On each anniversary of Commercial Close until the Substantial Completion Date (on which date the last submission under this Section 11.22 shall be made), Project Co shall provide an annual report to the College Contracting Authority on the implementation of the Apprenticeship Plan which report shall include, (i) statistics on the number of apprentices involved in the Project relative to the number of journeypersons, for each month of the Project; and (ii) detailed information setting out Project Co’s progress toward achieving the objectives set out in the Apprenticeship Plan, including an identification of an any barriers that prevented Project Co from achieving its objectives. (d) The College Contracting Authority may require Project Co to amend its Apprenticeship Plan if, in its opinion, acting reasonably, Project Co is failing to maximize apprenticeship opportunities on the Project pursuant to the then current Apprenticeship Plan. (e) The College Contracting Authority may, in its sole discretion, release Project Co’s Apprenticeship Plan to the public. Project Co’s Apprenticeship Plan shall not be Confidential Information.

The Apprenticeship Plan shall include, (i) specific objectives and methods for training and apprenticeship opportunities for the Project on a trade-by- by-trade basis; (ii) apprenticeship opportunities for each trade required on the Project; (iii) the number of apprentices to be employed for the Works, shall be in accordance with journeyperson to apprentice ratios established in section 60 of the Ontario College of Trades and Xxxxxxxxxxxxxxx Xxx, 0000, or in any successor legislation thereto; (iv) a confirmation that apprenticeships will be registered with the Ministry of Training, Colleges and Universities and the Ontario College of Trades, as applicable; (ivv) a program to ensure the required supply of apprentices to meet Project Co’s Apprenticeship Plan targets and requirements; (vvi) a program to support apprentices on the Project, Project to complete their apprenticeships during the Project Term prior to Substantial Completion and, for those whose apprenticeships are not complete by the end of the Project Term Substantial Completion Date a program to support apprentices apprentices, on a commercially reasonable basis, to complete their apprenticeships after the end of the Project TermSubstantial Completion Date; and (vivii) a focused apprenticeship program for youth-at-riskrisk youth, local communitieshistorically disadvantaged groups including low-income, racialized and immigrant populations, women, aboriginal persons, newcomers to Ontario, veterans, persons with disabilities, and military veteransresidents of the community(ies) in which the Project is located. (b) Project Co shall implement the approved Apprenticeship Plan. (c) On each anniversary of Commercial Close until the Substantial Completion Date (on which date the last submission under this Section 11.23(c) shall be made), Project Co shall provide an annual report to the College Contracting Authority on the implementation of the Apprenticeship Plan which report shall include, (i) statistics on the number of apprentices involved in the Project relative to the number of journeypersons, for each month of the Project; and (ii) detailed information setting out Project Co’s progress toward achieving the objectives set out in the Apprenticeship Plan, including an identification of an any barriers that prevented Project Co from achieving its objectives. (d) The College Contracting Authority may require Project Co to amend its Apprenticeship Plan if, in its opinion, acting reasonably, Project Co is failing to maximize apprenticeship opportunities on the Project pursuant to the then current Apprenticeship Plan. (e) The College Contracting Authority may, in its sole discretion, release Project Co’s Apprenticeship Plan to the public. Project Co’s Apprenticeship Plan shall not be Confidential Information.

(e) The College Osler may, in its sole discretion, release Project Co’s Apprenticeship Plan to the public. Project Co’s Apprenticeship Plan shall not be Confidential Information.

The Apprenticeship Plan shall include, (i) specific objectives for apprenticeship opportunities for the Project on a trade-by- by-trade basis; (ii) apprenticeship opportunities for each trade required on the Project; (iii) a confirmation that apprenticeships will be registered with the Ministry of Training, Colleges Advanced Education and Universities Skills Development and the Ontario College of Trades, as applicable; (iv) a program to ensure the required supply of apprentices to meet Project DB Co’s Apprenticeship Plan targets and requirements;; and (v) a program to support apprentices on the Project, to complete their apprenticeships during the Project Term and, for those whose apprenticeships are not complete by the end of the Project Term a program to support apprentices to complete their apprenticeships after the end of the Project Term; and (vi) a focused program for youth-at-risk, local communities, and military veterans. (b) Project DB Co shall implement the approved Apprenticeship Plan. (c) Project DB Co shall provide an annual report to the College City on the implementation of the Apprenticeship Plan which report shall include, (i) statistics on the number of apprentices involved in the Project relative to the number of journeypersons, for each month of the Project; and (ii) detailed information setting out Project DB Co’s progress toward achieving the objectives set out in the Apprenticeship Plan, including an identification of an barriers that prevented Project DB Co from achieving its objectives. (d) The College City may require Project DB Co to amend its Apprenticeship Plan if, in its opinion, acting reasonably, Project DB Co is failing to maximize apprenticeship opportunities on the Project pursuant to the then current Apprenticeship Plan. (e) The College City may, in its sole discretion, release Project DB Co’s Apprenticeship Plan to the public. Project DB Co’s Apprenticeship Plan shall not be Confidential Information.

(e) The College Contracting Authority may, in its sole discretionSole Discretion, release Project Co’s Apprenticeship Plan to the public.
