Common use of Arbitration Fees and Expenses Clause in Contracts

Arbitration Fees and Expenses. The fees and expenses of the arbitrator shall be shared equally among the parties involved in the arbitration, unless the decision of the arbitrator shall specify some other apportionment of such fees and expenses. All other expenses and costs of the arbitration shall be borne by the party incurring the same.

Arbitration Fees and Expenses. The expenses and fees of the Arbitrator(s) shall be divided equally among all of the parties to the arbitration. Each party to any arbitration commenced hereunder shall be responsible for and shall bear its own attorneys’ fees, witness fees and other costs or expenses of incurred in connection with such arbitration. The foregoing notwithstanding, the arbitrator shall be shared equally among Arbitrator(s) may award arbitration costs, including Arbitrators’ fees but excluding attorneys’ fees, to the parties involved in the arbitration, unless the decision of the arbitrator shall specify some other apportionment of such fees and expenses. All other expenses and costs of the arbitration shall be borne by the party incurring the sameprevailing party.

All it being mutually agreed that all other expenses including, but not limited to, fees for witnesses, transcripts, and similar costs of the incurred during such arbitration shall will be borne by the party incurring them. The decision of an arbitrator resulting from any arbitration of a grievance hereunder shall be final and binding upon the sameparties.
