Access to Official Employee File. Members shall have the right to examine their official employee file maintained in People and Resources at any time during regular office hours in company with a People and Resources employee. Examination of the file shall be kept in confidence. The member may be accompanied by an Association member of his/her own choosing. Members may add to the file a response to any document contained therein.
Access to Official Employee File. ‌ (a) An employee or designate shall have access to all material in their official employee file at a time mutually convenient to the employee and the Human Resources Division. (b) Examination of the contents of their official employee file shall be in the presence of a person authorized by the Human Resources Division. (c) An employee and Union shall be provided with a copy of all letters of reprimand, censure, and any other document which may be the basis of disciplinary action at the time of filing. (d) An employee upon request, shall be entitled to receive a copy of any document contained within their official employee file at the time of examination. (e) Should an employee dispute any entry or document in their official employee file they shall be entitled to recourse to the Grievance Procedure. (f) Eventual resolution of any dispute shall be part of the person's official employee file. (g) The Employer agrees not to introduce as evidence in any hearing any document from the official employee file of an employee, the existence of which the employee was not aware at the time of filing. (h) Letters of censure, reprimand, discipline and all adverse statements shall be removed from the official employee file after the employee has worked the number of regular hours equivalent to two (2) years of full-time employment from the date it was issued, provided there has not been a further infraction.
