Common use of Arbitrator's Role Clause in Contracts

Arbitrator's Role. The arbitrator shall have the right to determine the rules and procedure of the conduct of the hearing; PROVIDED, however, that the function of the arbitrator to hear the matter in dispute between the parties shall be limited to determining if the District or Association has violated or failed to follow any of the provisions of this Agreement between the parties. The arbitrator shall have no power to destroy, change, add to or delete from the terms of this Agreement. Any decision by the Arbitrator shall be final and binding upon both parties.
