Common use of Arriving Vessels Clause in Contracts

Arriving Vessels. Arriving Vessels shall be placed in a queue and berthed on a first come-first served basis. Seller generally shall take Vessels into berth at the Cargo Transfer Point in the same chronological order as Seller’s receipt of NORs, provided, however, that if the Cargo Transfer Point has special barge berths, barges shall use barge berths rather than ocean tanker dock berths. Seller reserves the right, in its sole discretion, to take one or more later arriving Vessels out of sequence, in which event all delay thereby caused in berthing the Vessel shall count as laytime or time on demurrage.
