ASBESTOS AND HAZARDOUS WASTE. If Contractor encounters asbestos or other hazardous materials, Contractor must immediately stop work and allow City to obtain a duly qualified asbestos and/or hazardous materials Contractor to perform the necessary work. If Contractor is qualified to remove asbestos or other hazardous materials, City may engage Contractor to do the work. Said work will be treated as extra work under this Agreement.

ASBESTOS AND HAZARDOUS WASTE. Mortgagor shall comply with Environmental Laws to the extent provided in the Credit Agreement. If Mortgagor shall fail to so comply to the extent required in the Credit Agreement, Mortgagee may declare an Event of Default and may (but shall not be obligated to) do whatever is necessary to comply with the applicable Environmental Laws, and the costs thereof, with interest at the Default Rate, shall be immediately due from Mortgagor to Mortgagee and the same shall be added to the Indebtedness and be secured by this Mortgage. If an Event of Default exists, Mortgagor shall give Mortgagee and its agents and employees access to the Premises to cause such compliance.

Unless the contract specifically calls for the removal, disturbance or transportation of asbestos or other hazardous substances, the parties acknowledge that such work requires special procedure, precautions, and/or licenses. Therefore, if PMNC encounters such substances, PMNC shall immediately stop work and allow the CLIENT to obtain duly qualified asbestos and/or hazardous material contractor to perform the work or PMNC may perform the work at PMNC’S option. Said work will be treated as an extra under the contract.

  • Hazardous Substances The words "Hazardous Substances" mean materials that, because of their quantity, concentration or physical, chemical or infectious characteristics, may cause or pose a present or potential hazard to human health or the environment when improperly used, treated, stored, disposed of, generated, manufactured, transported or otherwise handled. The words "Hazardous Substances" are used in their very broadest sense and include without limitation any and all hazardous or toxic substances, materials or waste as defined by or listed under the Environmental Laws. The term "Hazardous Substances" also includes, without limitation, petroleum and petroleum by-products or any fraction thereof and asbestos.
