Common use of Asbestos Clause in Contracts

Asbestos. Employees required to use materials containing asbestos or to work in close proximity to employees using such materials shall be provided with and shall use all necessary safeguards as required by the appropriate occupational health authority and where such safeguards include the mandatory wearing of protective equipment (i.e. combination overalls and breathing equipment or similar apparatus) shall be paid 58 cents per hour extra whilst so engaged.

Asbestos. (ii) Employees engaged in a work process involving asbestos who are required to wear protective equipment, i.e. respiratory protection in the mandatory wearing form of protective equipment (i.e. combination overalls and breathing equipment or similar apparatus) shall a high efficiency class H particulate respirator and/or special clothing, will be paid 58 cents an allowance of $0.67 per hour extra for each hour or part thereof whilst so engaged.

For the mandatory wearing of protective equipment (i.e. such as combination overalls and breathing equipment overalls, respirators or similar apparatus) safety equipment the employee shall be paid 58 cents the rate per hour extra whilst so engagedwhere these safeguards are in use. To be eligible for this allowance employees required to work with asbestos materials must have undertaken practical training and be in possession of current accreditation issued by a recognised RTO.
