Common use of Assessment and Treatment Clause in Contracts

Assessment and Treatment. The employee may be relieved from duty and placed on sick leave, vacation leave, or leave without pay pending completion of any initial chemical dependency assessment and successful completion of any in-patient chemical dependency rehabilitation program certified by the Department of Social and Health Services, Division of Behavioral Health and Recovery (DBHR). The employee will provide the Human Resource Manager with the date the assessment is scheduled and the date the assessment is completed. During out-patient treatment, employees will continue to work with Human Resources on the progress of their treatment on a regular and agreed to basis. If the assessment results in a recommendation for an out-patient treatment program, the employee will enter a return to work agreement before being allowed to return to work. An employee will be discharged if they refuse to participate in or successfully complete any DBHR certified program.
