Common use of Assignment of Arbitrator Clause in Contracts

Assignment of Arbitrator. (a) When a party has requested that a grievance be submitted to arbitration and either party has requested that a hearing date be set, the parties shall assign an arbitrator from the mutually agreed upon list of arbitrators or a mutually agreed upon substitute, and set a date for the hearing. (b) The parties shall agree upon a list of arbitrators, which shall be appended to this Agreement (see Appendix C). An arbitrator may be removed from or added to the list by mutual agreement. (c) Depending upon availability, arbitrators shall be assigned cases on a rotating basis, or by mutual agreement.
