Award to Other than the Lowest Bidder. In accordance with 49 U.S.C. § 5325(c), a Recipient may award a third party contract to other than the lowest bidder, if the award furthers an objective (for example, improved long-term operating efficiency and lower long-term costs) that is consistent with the purposes of 49 U.S.C. chapter 53, and any implementing Federal regulations or directives that FTA may issue, except to the extent FTA determines otherwise in writing.

Award to Other than the Lowest Bidder. In accordance with 49 U.S.C. §5325(c), a Transit Provider may award a third party contract to a party other than the lowest bidder, when such an award furthers objectives consistent with the purposes of 49 U.S.C. Chapter 53 and any implementing regulations, directives, circulars, manuals, or other guidance FTA may issue and is consistent with state law.

  • Reallocation to a Class with a Lower Salary Range Maximum 1.
