Background Screenings of Staff and Volunteers. a. The AGENCY shall ensure that, at no cost to the County, its employees and volunteers undergo any and all background screening as may be required by applicable federal, state, or local law. b. If the AGENCY, either as a whole or with a specifically defined program, offers care (i.e.: treatment, education, training, instruction, supervision, or recreation) or placement services geared towards minors, the elderly, or individuals with disabilities, then the AGENCY shall ensure that a Level II Background Screening in accordance with Section 435.04, Florida Statutes, is performed for each of its employees and volunteers that have, or may have access to such minors, the elderly, or individuals with disabilities. The AGENCY may utilize background screenings conducted by Orange County Public School System providing that all Level ll Background Screening requirements are met. c. The COUNTY reserves the right to require that the AGENCY, at no cost to the COUNTY, pursue Level II Background Screening for its employees and volunteers that have, or may have access to minors, the elderly, or individuals with disabilities pursuant to their performance under this Contract, even if the Services are targeted for the general population. If the COUNTY makes such requirement and the Florida Department of Law Enforcement’s Volunteer and Employee Criminal History System Program (“VECHS”) of the AGENCY rejects the AGENCY’s application for failure to be a qualified entity, the County will accept such written rejection in lieu of the performance of such background checks. The AGENCY shall keep record of all employees and volunteers that require background checks under federal, state, local law, and/or this Contract. The AGENCY shall additionally ensure that all such employees and volunteers have had the requisite background checks performed prior to their provision of any Services funded through this Contract and that all requisite background checks are kept current in compliance with the applicable law. d. Upon request, the AGENCY shall submit to the COUNTY written confirmation that any and all background screenings required by applicable federal, state, or local law have been conducted and that the results are acceptable to the AGENCY and comply with all applicable federal, state, and local laws.
