Background Screening. VENDOR shall comply with all requirements of Sections 1012.32 and 1012.465, Florida Statutes, and all of its personnel who (1) are to be permitted access to school grounds when students are present, (2) will have direct contact with students, or (3) have access or control of school funds, will successfully complete the background screening required by the referenced statutes and meet the standards established by the statutes. This background screening will be conducted by SBBC in advance of VENDOR or its personnel providing any services under the conditions described in the previous sentence. VENDOR shall bear the cost of acquiring the background screening required by Section 1012.32, Florida Statutes, and any fee imposed by the Florida Department of Law Enforcement to maintain the fingerprints provided with respect to VENDOR and its personnel. The parties agree that the failure of VENDOR to perform any of the duties described in this section shall constitute a material breach of this Agreement entitling SBBC to terminate immediately with no further responsibilities or duties to perform under this Agreement. VENDOR agrees to indemnify and hold harmless SBBC, its officers and employees from any liability in the form of physical or mental injury, death or property damage resulting from VENDOR’s failure to comply with the requirements of this section or with Sections 1012.32 and 1012.465, Florida Statutes.

Project Consultant agrees to comply with all requirements of Sections 1012.32 and 1012.465, Florida Statutes, and that Project Consultant, its agents, subconsultants and all of its personnel who (1) are to be permitted access to school grounds when students are present, (2) will have direct contact with students, or (3) have access or control of school funds will successfully complete the background screening required by the referenced statutes and meet the standards established by the statutes. This background screening will be conducted by SBBC in advance of Project Consultant or its personnel providing any services under the conditions described in the previous sentence. Project Consultant agrees to indemnify and hold harmless SBBC, its officers and employees from any liability in the form of physical or mental injury, death or property damage resulting from Project Consultant’s failure to comply with the requirement of this Section or Section 1012.32 and Section 1012.465, Florida Statutes in addition to any other indemnification obligations that may be imposed upon Project Consultant pursuant to Article 8 of this Agreement and the laws of Florida.
Background Screening. Charter School shall perform background screening through the MPS Office of Human Capital on all Charter School full- and part-time employees and volunteers. Charter school shall not allow any employee or volunteer to have contact with pupils until Charter School, in consultation with the MPS Office of Human Capital, investigates and determines that there is nothing in the background of the employee or the volunteer which would render the employee or volunteer unfit to have contact with pupils of Charter School, including, but not limited to, conviction of a criminal offense or pending charges which substantially relate to the duties and responsibilities assigned to the employee and/or volunteer. For purposes of this Contract, volunteer means a non-paid person who serves under the supervision of Charter School and who provides services on a regular and ongoing basis or for more than five hours a week. It does not apply to those parents and/or other adults who are one-time volunteers for field trips or other one-time only activities in Charter School. Charter School shall obtain the social security number of all individuals who are volunteers having contact with Charter School pupils or individuals who are employed by Charter School on either a full or part-time basis. Such social security numbers shall be retained by Charter School and shall be provided to MPS upon request. Charter School shall pay for costs incurred by the MPS Office of Human Capital in performing these functions for Charter School. Such costs, as determined by the Board, shall be included in the administrative fee under paragraph I.W.
Background Screening. (i) In accordance with Florida Statute (S.) 1012.465, all contractors, vendors, individuals and other entities under contract with the School Board, and the employees and subcontractors of any such contracting party, who are permitted on school grounds when students are present; who have direct contact with students; or who have access to or control of school funds must meet Level 2 screening requirements as described in Section 1012.32, Florida Statutes unless otherwise exempted from such requirements by S. 1012.467 or S. 1012.468. A Level 2 screening includes conducting a background check and filing with the Okaloosa County School District a complete set of fingerprints of each individual, employee, or subcontractor taken by an authorized school district agent trained to take fingerprints. The Provider shall bear the costs of all such background screening and fees to maintain the fingerprints provided with respect to Provider and its employees.
(ii) Any personnel of the Provider discovered, through fingerprint processing, to have been found guilty of, regardless of adjudication, or entered a plea of nolo contendere or guilty to any offense outlined in Section 435.04, Florida Statutes (or any similar statute of another jurisdiction), shall not be permitted to come onto school grounds or school-sponsored activities when students are present, or to have access to School District funds.
(iii) It is the responsibility of the Provider to assure compliance with this requirement. Provider agrees that in the event the Provider or any employee is later convicted of, or pleads nolo contendere to any disqualifying offense as outlined in Section 435.04, Florida Statutes the Provider will notify School Board within 48 hours of such.
(iv) The parties agree that the Provider’s failure to perform any of the duties described in this section will constitute a material breach of this contract entitling the School Board to terminate immediately with no further responsibility to make payment or perform any other duties under this contract. Provider agrees to indemnify and hold harmless the School Board, its officers and employees from any liability in the form of physical injury, death, or property damage resulting from Provider’s failure to comply with the requirements of this section or sections 1012.32, 1012.465, 1012.467, and 1012.468 Florida Statutes.

Contractor shall abide by any standards set by the MPS Office of Human Resources with respect to fitness for employment or volunteering. For purposes of this Contract, volunteer means a non-paid person who serves under the supervision of Contractor and who provides services on a regular and ongoing basis or for more than 5 hours a week. It does not apply to those parents or other adults who are one-time volunteers for field trips or other one-time-only activities of Contractor. Contractor shall obtain the social security number of all individuals who are volunteers having contact with Contractor pupils or individuals who are employed by Contractor on either a full or part-time basis. Such social security numbers shall be retained by Contractor and shall be provided to the Board upon request. Contractor shall pay for the costs, if any, incurred by the MPS Office of Human Resources in assisting Contractor in performing its duties under this paragraph. Contractor hereby certifies that neither Contractor or its principals nor Contractor’s subcontractors or its principals are listed as debarred or suspended in the System for Award Management (XXX), the government-wide exclusion list maintained by the federal government.
Background Screening. In addition to any background screening required by the Contractor as a condition of employment, the Contractor warrants that it will conduct a criminal background screening of, or ensure that such a screening is conducted for, each of its employees, subcontractor personnel, independent contractors, leased employees, volunteers, licensees or other person, hereinafter referred to as “Person” or “Persons,” operating under their direction who directly perform services under the Contract, whether or not the Person has access to State of Florida Data, as well as those who have access, including indirect access, to State of Florida Data, whether or not they perform services under the Contract. The Contractor warrants that all Persons will have passed the Background Screening described herein before they have Access to Data or begin performing services under the contract. The look-back period for such background screenings shall be for a minimum of six (6) years where six (6) years of historical information is available.
Background Screening. As a public school, FLVS complies with all statutes regarding background screening of employees, in accordance with Florida law.
Background Screening. The Sub-Recipient shall ensure that the requirements of Section 430.0402 and Chapter 435, F.S., as amended, are met regarding background screening for all persons who meet the definition of a direct service provider and who are not exempt from the DOEA`s level 2 background screening pursuant to Sections 430.0402(2)-(3), F.S. The Sub-Recipient must also comply with any applicable rules promulgated by the DOEA and the Agency for Health Care Administration regarding implementation of Section 430.0402 and Chapter 435, F.S. To demonstrate compliance with this provision, Sub-Recipient shall submit the Background Screening Affidavit of Compliance (Screening Form) to the AAAPP within thirty (30) days of execution of this contract. Should the AAAPP have a completed Screening Form on file for the Sub-Recipient, a new Screening Form will be required every twelve (12) months.

Background Screening. The School shall implement policies and procedures for background screening of all prospective employees, volunteers and mentors.
Background Screening. The Provider shall comply with the Department’s Statewide Procedure on Background Screening for Employees, Vendors, and Volunteers that is available on the Department’s website. The Provider shall comply with the requirements for background screening pursuant to chapters 39, 435, 984 and 985, Florida Statutes and the Department’s background screening policy (FDJJ 1800 Revised 7/30/10 with corrections on 8/12/10). Failure to comply with the Department’s background screening requirements may result in termination of the Contract.
