Backup Measurement. Without prejudice to the obligation of CENIT set forth in Section 4.02 of this Chapter, in cases where for whatever reason it is not possible to apply the dynamic measurement methodology, the Parties agree that the static measurement methodology shall be applied according to the Quality Specifications for Crude Oil and the Measurement Manual incorporated herein as Annex DCC-7 or the ECOPETROL Measurement Manual, as applicable, in conformity with Section 4.01 of this Chapter.

Backup Measurement. Notwithstanding the provisions of Section 9.02 of this Chapter, in cases in which the dynamic measurement methodology cannot be used for some reason, the Parties agree that static measurement methodology shall be used, in accordance with the Product Quality Specifications and the Measurement Manual attached to this Master Service Contract as Annex TP-6 of Chapter I Product Transport Service by Polyduct or the ECOPETROL Measurement Manual, as applicable, in accordance with Section 8.01 of this Chapter.

  • Measurement Should the State terminate this contract as herein provided, no fees other than fees due and payable at the time of termination shall thereafter be paid to the Engineer. In determining the value of the work performed by the Engineer prior to termination, the State shall be the sole judge. Compensation for work at termination will be based on a percentage of the work completed at that time. Should the State terminate this contract under paragraph (4) or (5) above, the Engineer shall not incur costs during the thirty-day notice period in excess of the amount incurred during the preceding thirty days.

  • Measurement and Monitoring Tools Contractor shall implement measurement and monitoring tools and procedures reasonably designed to measure its performance of the Services and assess such performance against any applicable service levels. Contractor shall provide LAUSD with a monthly report of service level performance under any applicable Work Order. Upon LAUSD’s request, Contractor shall provide LAUSD with access to the measurement and monitoring tools described herein, and to any information that they generate.
