Bald and Golden Eagle Protection Act. (BGEPA) The Bald and Golden Eagle Protection Act (16 U.S.C. 668-668d) prohibits anyone, without a permit issued by the Secretary of the Interior, from "taking" bald eagles, including their parts, nests, or eggs. WisDOT will coordinate with WDNR to identify known eagle nesting areas near the project prior to commencing construction. Bald and Golden Eagle Protection Act. The Bald and Golden Eagle Protection Act of 1940, as amended, provides for the protection of the bald eagle (Haliaeetus leucocephalus) and the golden eagle (Aquila chrysaetos) by prohibiting, except under certain specified conditions, the taking, possession, and commerce of these birds. Bald and golden eagles may fly over the Project Area and may roost on rocky cliffs within the canyon. Bald eagles are considered potential occasional visitors to the area, but would not be expected to nest or occur there on a regular basis. Cliffs within the area provide suitable nesting habitat for golden eagles (see Section 3.4). Romin and Xxxx (2002) suggest a spatial and seasonal buffer on active golden eagles nests of 0.5 miles and 1 January - 31 August, respectively. Thus, a golden eagle nest survey would be conducted prior to any construction during the seasonal window.
