Common use of Bargaining State Mandates Clause in Contracts

Bargaining State Mandates. If new state mandates appear to conflict with the current Collective Bargaining Agreement, either party may initiate negotiations by notifying the other party of the specific provisions of the current Collective Bargaining Agreement that are to be bargained. The parties will negotiate for fifteen (15) days after the initial contact unless the fifteen (15) day deadline is extended by mutual agreement. If no agreement is reached, a final offer binding arbitration may be requested by mutual agreement. If no agreement to request arbitration is reached, then the Collective Bargaining Agreement remains unchanged and the issue will be a mandatory subject of bargaining at the next contract re-opener.
