Common use of Benefits Review Clause in Contracts

Benefits Review. If the claim is completely or partially denied, the Plan Administrator will furnish a written notice to the claimant containing the following information: (a) specific reasons for the denial; (b) specific references to the Plan provisions on which any denial is based; (c) a description of any additional material or information that must be provided by the claimant in order to support the claim and an explanation of why such material or information is necessary; and (d) an explanation of the Plan’s appeal procedures which shall also include a statement of the claimant’s right to bring a civil action under Section 502(a) of ERISA following a denial of the claim upon review.
