When I schedule a bill payment using Online Banking Services, I authorize you to withdraw the necessary funds from my Business Membership Savings Account, Business Regular Savings Account, Business Money Market Account, BayBusiness Basic Checking Account, BayBusiness Checking Account, or BayBusiness Plus Checking Account. I agree that I will instruct you to make a withdrawal only when a sufficient balance is or will be available in my designated Account or the funds are available through my Business Checking Account overdraft source(s). b. While it is anticipated that most transactions will be processed five (5) business days before my scheduled payment date, I understand that due to circumstances beyond your control, particularly delays in handling and posting payments by slow responding companies or financial institutions, some transactions may take a day or even a few days longer to post to my Account with the designated payee. For this reason, all the bill payment dates should be scheduled by me at least seven (7) business days before the actual due date (not the late date and/or the grace period). A bill payment scheduled to be made on a day that is not a business day will be made on the next business day. If I properly follow the procedures described herein, and you fail to send a payment according to the payment instructions received, you shall be responsible for returning the improperly transferred funds to my Account and for directing to the proper recipient any previously misdirected bill payments or transfers. In the event, including, but not limited to, scheduling a payment date which is not at least seven (7) business days before the due date, or on or past the due date stated on my bill, the risk of incurring and responsibility for paying any and all late charges or penalties shall be borne by me. c. Bill Payments. a. You should be aware that other transactions (such as ATM, telephone banking, on-line transfers or in- branch withdrawals) may affect the amount between $1 and $25,000. of funds available to make your payment.
b) When I you schedule a bill payment using Online Banking Servicestransaction, I you authorize you Genesee Co-op to withdraw reduce the necessary funds from my Business Membership Savings Account, Business Regular Savings Account, Business Money Market Account, BayBusiness Basic Checking Account, BayBusiness Checking Account, or BayBusiness Plus Checking AccountAccount balance accordingly. If I properly follow the procedures described herein, and W e will attempt to notify you fail via Business Online if any Bill Payment you submitted via Business Online cannot be com pleted. Bill Paym ents may be either electronically for Payees who are set up by our vendor to send a payment according receive electronic payments or by paper checks mailed to the payment instructions received, you shall Payee. Bill Paym ents which can be responsible for returning the improperly transferred funds to my Account and for directing delivered electronically are generally delivered to the proper recipient any previously misdirected bill payments or transfersPayee in three (3) Business Days of the Scheduled Date and paper checks are generally delivered to within six (6) Business Days of the Scheduled Date. In addition, posting time may depend on payee processing and, in the eventcase of paper checks, includingupon mail time. For exam ple, but not limited toBill Paym ents sent to certain payees, scheduling a payment date which is not at least seven (7) business days e.g. governm ent agencies, may take longer to be delivered and/or processed. You should allow sufficient time for us to receive and process your Bill Paym ents so that the funds can be delivered to the Payee on or before the due datedate for such payment, not taking into account any grace period provided by the Payee and you assum e all liability for late fees, finance charges and other actions taken by a Payee if payments are received late. In addition to the other lim itations contained in this Agreem ent, you agree that we will not be liable in any way for dam ages you incur (a) if you do not have sufficient funds in your designated account to make the Bill Paym ent on the Scheduled Date, (b) if the estimated of time to allow for delivery to the Payee is inaccurate, (c) if there are delays due to m ail delivery, changes of merchant address or account number, the failure of any merchant to account correctly for or credit the paym ent in a timely manner, or on for any other circum stances beyond our control. You may cancel a Bill Paym ent in accordance with the Service Rules, which generally require that the Bill Paym ent be cancelled before an established time the date BEFORE the Scheduled Date. Once the Bill Paym ent has entered the processing phase, you CANNOT cancel or past the due date stated on my billstop a bill paym ent. W e will not be held liable for failing or refusing to process and effect a stop payment. If we are able to accept and process your request to stop payment of a paper check used to make a Bill Paym ent, the risk of incurring and responsibility for paying any and all late charges or penalties shall you will be borne by mecharged a stop payment fee in effect at that time.
c. I agree to enter my Account number and address as they appear on my payment stub or bill when adding payees to the Online Banking Service.
d. For purposes of Online Banking, a business day is defined as Monday - Friday.
e. I understand that any Authorized Signer on the Account can sign up for Online Banking. I hereby agree to indemnify, defend, and hold you harmless from acting upon the request of any Authorized Signer on the Account.

Bill Payments. a. I understand This section sets forth the terms and agree that I must be 18 years conditions under which the Bill Payment Service is offered. The Bill Pay Service allows a Sender to schedule payments online for current, future and recurring bills from your FNCU share draft account. These Terms of age Use affect your rights, you should read them carefully. You may make payments through Bill Payment Service (or age of majority depending on the state in which I reside“Bill Pay Service”) to set up any business, person or use Online Bankingprofessional ("Payee") that has an address which can verified. Bill Payments (“payments”) may be made only to Payees with a United States payment address. Bill Pay reserves the right to refuse to accept any bill payment transaction. Bill Payments for alimony, child support, taxes, government fees, or court ordered payments are not always accepted. You can make these payments, but Bill Pay Service do not guarantee that it will be accepted or posted in a timely fashion. You must do so at your own risk.
a) Bill payments will be sent to the payee either electronically or by paper check mailed to the payee via the U.S. Postal Service. The choice of electronic or paper check is solely at the discretion of Bill Pay Service. Checks, electronic payments, and withdrawal orders of any kind can be drawn on your Account in any order. You should be aware that other transactions (such as ATM, telephone banking, on-line transfers or in- branch withdrawals) may affect the amount between $1 and $25,000. of funds available to make your payment.
b) When I you schedule a bill payment using Online Banking Servicestransaction, I you authorize you FNCU to withdraw reduce the necessary funds from my Business Membership Savings Account, Business Regular Savings Account, Business Money Market Account, BayBusiness Basic Checking Account, BayBusiness Checking Account, or BayBusiness Plus Checking AccountAccount balance accordingly. I agree that I will instruct you If the available balance in the Account is not sufficient to make a withdrawal only when a sufficient balance is payments you have authorized, FNCU may either refuse to pay the item or will make the payment and thereby overdraw the account. In either event, you are responsible for any insufficient funds and overdraft charges that may be available imposed, as stated in my designated Account the FNCU’s fee and disclosure statements. FNCU reserves the right to refuse to honor payment requests that may reasonably appear to be fraudulent or the funds are available through my Business Checking Account overdraft source(s)erroneous.

The day that on which the payment is not to be sent is referred to as the "Date/Recurrence." If the payment date/recurrence is scheduled for a non-business day day, it will be made processed on the next prior business day.
