In emergency situations, the Board may waive the degree requirements; employment shall comply with state certification code. 3. To approve and establish levels and courses of instruction, including special programs, and to provide for athletic, recreational and social events for students. 4. To approve and provide the selection of textbooks, teaching materials, technology, and aids necessary for an adequate instructional program and have the foregoing available by the opening of school under normal circumstances. 5. To determine class schedules, the hours of instruction, and the duties, responsibilities, and assignments of teachers subject to the express provisions of this Agreement. 6. To reprimand, discipline or discharge employees, but not in conflict with the terms of this Agreement or the laws of the State of Michigan. 7. To adopt rules and regulations. 8. “An emergency manager appointed under the local government and school district fiscal accountability act may reject, modify or terminate the collective bargaining agreement as provided within the “Local government and school district fiscal accountability act.” B. It is noted the responsibility of union does not agree or acknowledge this provision as binding and reserves all rights to assert this clause as unenforceable. The District will attain costs for Dental & Vision Coverage for the Board membership to maintain purchase at 100% cost through the School District (acting as a list of substitute teachers conduit between the health insurance company and arrange for substitution when teachers are absentthe member). The Association expressly recognizes and refers to these management rights and responsibilities as conferred by the laws and constitution of the State of Michigan. Such rights shall include include, by way of illustration and not by way of limitation, limitation the rightright to:
1. To execute management Manage and administrative control its business, its equipment and its operations and to direct the working forces and affairs of the school system and its properties and facilities, and the school activities of its employees during the employee working hoursdistrict.

To hire all employees andContinue its rights, subject to policies and practices of assignment and direction of its personnel and determining the number of personnel but not in conflict with the specific provisions of lawthis Agreement, to evaluate unless any provision or application of this agreement prohibits the District from complying with State and determine their qualifications and conditions for their employment and their continued employment, or their dismissal or demotion; and to promote, and transfer all such employees. In emergency situations, the Board may waive the degree requirements; employment shall comply with state certification codeFederal Laws.
3. To approve Determine the services, supplies and establish equipment necessary to continue its operations.
4. Adopt reasonable rules, policies and regulations.
5. Determine the number and location or relocation of its facilities, including the establishment or relocation of new schools, buildings, departments, divisions and subdivisions thereof.
6. Determine the financial policies, including all accounting procedures.
7. Determine the size of the management organization, its functions, authority, amount of supervision and table of organization.
8. Establish levels and courses of instruction, including special programs, programs and to provide for athletic, recreational and social events for students.
4. To approve B. In order to comply with Section 164h(1)(d) of PA 108 of 2017, modify or terminate the collective bargaining agreement as provided within the “Local government and school district fiscal accountability act.”
B. It is the responsibility of the Board shall adopt policies to maintain a list comply with this provision and communicate the details of substitute teachers and arrange for substitution when teachers are absent. Teachers will be provided with a telephone number, which they may call if they are not available for work on any specific day or any period those policies no later than October 1 of timeeach year.
C. The Board, by the beginning of the school year, shall provide the Association President with a copy of the present chapter on “Professional Staff” from the Board of Education Policy Manual. New teaching staff shall also receive the present “Professional Staff” chapter. When the “Professional Staff” chapter is amended during the school year the amended policies shall be sent to the Association President within 5-days after the revised policies are received back from XXXXX.
