Bollard Pull. Should the bollard pull of the vessel as recorded during the official sea trial be less than the Bollard Pull contracted in Article 2.8 and should the Builder be unable to remedy this defect within reasonable time, then the Owner can reject the Vessel. In such event the Builder shall refund immediately to the Owner the full amount the Owner has paid to the Builder under this Contract together with the original cost of the Owner Furnished Equipment delivered to the Builder, plus interest thereon at the rate of 2% above prevailing prime rate of DBS Bank, Singapore from the date following the date of receipt by the Builder of such pre-delivery installment(s) to the date of payment by the Builder to the Owner of the refund, whereupon this Contract shall be deemed to be rescinded and all rights, duties, liabilities and obligations of each of the Parties to the other shall terminate.

Bollard Pull. 7.1.3.1 If the Bollard Pull, as determined at the Sea Trials, is less than 5.5 tons, the Purchaser shall (at its option) have the following remedies: (A) The Purchaser may require that the deficiency in Bollard Pull be remedied within one month of Purchaser's demand for remedy, in which case additional Sea Trials shall be conducted to determine if the Bollard Pull is at least 5.5 tons; or (B) The Purchaser may accept the Vessel with the reduced Bollard pull, in which case the Purchase Price shall be reduced by $50,000; or (C) The Purchaser may reject the Vessel and terminate this Agreement in accordance with the provisions of Article 7.3 hereof.

The shop xxxxxxx, or their designee, involved with a particular grievance must be identified at Step 1 of the grievance procedure and will be designated as the only bargaining unit employee who will be able to gather information pertaining to that particular grievance. In order to use union leave for this purpose, Shop Stewards must notify the supervisor/department head of meetings and other commitments at the time these are scheduled. Attendance at meetings specified in Step 3 of the grievance procedure shall be considered hours worked during regularly scheduled business hours of the County for the xxxxxxx involved, witnesses and the grievant. The County shall not be liable for any overtime as a result of the meeting. Witnesses and the shop xxxxxxx involved shall be granted leave with pay to the extent their presence at the proceedings is required. If it is a discharge case the grievant shall not be paid except as provided in a remedy awarded.

(c) The Employer will pay a contribution on behalf of each Employee of $1.00 per week per Employee for the life of this Agreement in accordance with the relevant Incolink trust deed and/or Constitution and By-laws.
