BONA FIDE REQUEST PROCESS. 41.1. Sprint shall promptly consider and analyze CLEC requests for unbundled network elements included in this Agreement that are not currently developed by Sprint, network information that is reasonably required to determine what unbundled network elements it needs to serve a particular customer or development of and changes to Sprint work processes related to ordering, provisioning or installation of unbundled network elements with the submission of a Bona Fide Request (“BFR”) hereunder. 41.2. A BFR shall be submitted in writing on the Sprint Standard BFR Form and shall include a clear technical description of each request. 41.3. CLEC may cancel a BFR at any time, but shall pay all reasonable and demonstrable costs of processing and/or implementing the BFR up to the date of cancellation. 41.4. Within ten (10) calendar days of its receipt, the Sprint shall acknowledge receipt of the BFR. 41.5. 41.23.2. Sprint shall promptly consider and analyze access to UNEs or combinations of UNEs not specifically covered in this Agreement with the submission of a Bona Fide Request (“BFR”) hereunder.
3.3. A BFR shall be submitted in writing on the Sprint Standard BFR Form and shall include a clear technical description of each request.
41.3. CLEC KMC may cancel a BFR at any time.
3.4. If KMC cancels the BFR, but KMC shall pay all Sprint’s reasonable and demonstrable costs of processing and/or implementing the BFR UNE Bona Fide Request up to the date of cancellation.
41.43.5. Within ten (10) calendar days of its receipt, the Sprint shall acknowledge receipt of the BFRBFR and in such acknowledgement advise KMC of the need for any further information needed, to the extent such information can be assessed at that time, to process the Bona Fide Request.
41.53.6. Except under extraordinary circumstances, within thirty (30) calendar days of its receipt of a BFR, the Sprint receiving Party shall provide to CLEC the requesting Party a preliminary analysis of such BFR. If applicable, the preliminary analysis shall confirm whether the receiving Party will offer access to the UNE, including whether it is technically or operationally feasible.
41.63.7. Upon receipt of the preliminary analysis, CLEC the requesting Party shall, within thirty (30) calendar days, notify Sprintthe receiving Party, in writing, of its intent to proceed or not to proceed.
41.73.8. Sprint The receiving Party shall promptly proceed with the BFR upon receipt of written authorization from CLECthe requesting Party. When it receives such authorization, Sprint the receiving Party shall promptly develop the requested services, determine their availability, calculate the applicable prices prices, BFR development and processing costs, terms and conditions by which the Request shall be made available, and establish ordering and installation intervals.
41.83.9. Unless KMC agrees otherwise, the access to UNEs, combinations of UNEs, or services requested must be priced in accordance with the pricing principals of the Act, FCC and/or the State Commission.
3.10. As soon as feasible, but not more than ninety sixty (9060) calendar days after its receipt of authorization to proceed with developing the BFR, Sprint the receiving Party shall provide to CLEC the requesting Party a BFR Quote which will include, at a minimum, a description of each serviceservice or UNE, the availability, the applicable rates and the installation intervals.
41.93.11. Within thirty (30) calendar days of its receipt of the BFR Quote, CLEC the requesting Party must either confirm, in writing, its order for the BFR pursuant to the BFR Quote or if a disagreement arises, seek resolution of the dispute under the Dispute Resolution procedures in Part B of this Agreement.
41.103.12. If a Party to a BFR believes that the other Party is not requesting, negotiating negotiating, or processing the BFR in good faith, or disputes a determination, or price or cost quote, such Party may seek resolution of the dispute pursuant to via the Dispute Resolution provisions in Part B of this Agreement.

BONA FIDE REQUEST PROCESS. 41.1. Sprint shall promptly consider and analyze CLEC requests 16.1 Any request for unbundled network elements included in this Agreement that are not currently developed by Sprint, network information Interconnection or Ancillary service that is reasonably required not already available as described in other sections of this Agreement, including but not limited to determine what unbundled network elements it needs to serve Exhibit F or any other Interconnection Agreement, Tariff or otherwise defined by Qwest as a particular customer product or development of and changes to Sprint work processes related to ordering, provisioning or installation of unbundled network elements with the submission of service shall be treated as a Bona Fide Request (“BFR”) hereunder). Qwest shall use the BFR Process to determine the terms and timetable for providing the requested Interconnection or Ancillary services and the technical feasibility of new/different points of Interconnection. Qwest will administer the BFR Process in a non-discriminatory manner.
41.2. 16.2 A BFR shall be submitted in writing and on the Sprint Standard appropriate Qwest form for BFRs. VZW and Qwest may work together to prepare the BFR Form form and either Party may request that such coordination be handled on an expedited basis. This form shall include be accompanied by the non- refundable Processing Fee specified in Exhibit A of this Agreement. Qwest will refund on-half of the Processing Fee if the BFR is cancelled within ten (10) business Days of the receipt of the BFR form. The form will request, and VZW will need to provide, the following information, and may also provide any additional information that may be reasonably necessary in describing and analyzing VZW’s request:
16.2.1 a clear technical description of each requestrequested new or different point of Interconnection or Ancillary service;
16.2.2 the desired interface specification;
16.2.3 each requested type of Interconnection or access;
16.2.4 a statement that the Interconnection or Ancillary service will be used to provide a Telecommunications Service;
16.2.5 the quantity requested;
16.2.6 the specific location requested;
16.3 Within two (2) business Days of its receipt, Qwest shall acknowledge receipt of the BFR and in such acknowledgment advise VZW of missing information, if any, necessary to process the BFR. Thereafter, Qwest shall promptly advise VZW of the need for any additional information required to complete the analysis of the BFR. If requested, either orally or in writing, Qwest will provide weekly updates on the status of the BFR.
41.316.4 Within twenty-one (21) calendar Days of its receipt of the BFR and all information necessary to process it, Qwest shall provide to VZW an analysis of the BFR. CLEC may cancel The preliminary analysis shall specify Qwest’s conclusions as to whether or not the requested Interconnection is technically feasible.
16.5 If Qwest determines during the twenty-one (21) Day period that a BFR at any timedoes not qualify as an Interconnection or Ancillary service that is required to be provided under the Act or state law, Qwest shall advise VZW as soon as reasonably possible of that fact, and Qwest shall promptly, but shall pay all reasonable and demonstrable costs of processing and/or implementing in no case later than the twenty-one Day period, provide a written report setting forth the basis for its conclusion.
16.6 If Qwest determines during such twenty-one (21) Day period that the BFR up to qualifies under the date Act or state law, it shall notify VZW in writing of cancellation.
41.4. Within such determination within ten (10) calendar days Days, but in no case later than the end of its receipt, the Sprint shall acknowledge receipt of the BFRsuch twenty-one (21) Day period.
41.5. Except under extraordinary circumstances, within thirty (30) calendar days of its receipt of a BFR, the Sprint shall provide to CLEC a preliminary analysis of such BFR.
41.6. Upon receipt of the preliminary analysis, CLEC shall, within thirty (30) calendar days, notify Sprint, in writing, of its intent to proceed or not to proceed.
41.7. Sprint shall promptly proceed with the BFR upon receipt of written authorization from CLEC. When it receives such authorization, Sprint shall promptly develop the requested services, determine their availability, calculate the applicable prices and establish installation intervals.
41.8. 16.7 As soon as feasible, but not more than ninety in any case within forty-five (9045) calendar days Days after its receipt of authorization to proceed with developing Qwest notifies VZW that the BFRBFR qualifies under the Act, Sprint Qwest shall provide to CLEC VZW a BFR Quote which quote. The BFR quote will include, at a minimum, a description of each Interconnection and Ancillary service, the availabilityquantity to be provided, any interface specifications, and the applicable rates (recurring and nonrecurring) including the separately stated development costs and construction charges of the Interconnection Ancillary service and any minimum volume and term commitments required, and the installation intervalstimeframes within which the request will be provisioned.

41.10. 16.10 If a either Party to a BFR believes that the other Party is not requesting, negotiating or processing the any BFR in good faith, or disputes a determination, determination or quoted price or cost quotecost, such Party it may seek resolution of the dispute pursuant to invoke the Dispute Resolution provisions in Part B provision of this Agreement.
16.11 All time intervals within which a response is required from one Party to another under this Section are maximum time intervals. Each Party agrees that it will provide all responses to the other Party as soon as the Party has the information and analysis required to respond, even if the time interval stated herein for a response is not over.
16.12 In the event VZW has submitted a Request for an Interconnection or Ancillary services and Qwest determines in accordance with the provisions of this Section 16 that the request is technically feasible, subsequent requests or orders for substantially similar types of Interconnection or Ancillary services by that VZW shall not be subject to the BFR process. To the extent Qwest has deployed or denied a substantially similar Interconnection or Ancillary services under a previous BFR, a subsequent BFR shall not be required and the BFR application fee shall be refunded immediately. ICB pricing and intervals will still apply for requests that are not yet standard offerings. 41.339.3. CLEC may cancel a BFR at any time, but shall pay all the reasonable and demonstrable costs of processing and/or implementing the BFR up to the date of cancellation.
41.439.4. Within ten (10) calendar days of its receipt, the Sprint shall acknowledge receipt of the BFR.
41.539.5. Except under extraordinary circumstances, within thirty (30) calendar days of its receipt of a BFR, the Sprint shall provide to CLEC a preliminary analysis of such BFR.. If applicable, the preliminary analysis shall provide the rational for acceptance or denial of BFR

41.78.7. Sprint The receiving Party shall promptly proceed with the BFR upon receipt of written authorization from CLECthe requesting Party. 41.88.8. As soon as feasible, but not more than ninety (90) calendar days after its receipt of authorization to proceed with developing the BFR, Sprint the receiving Party shall provide to CLEC the requesting Party a BFR Quote which will include, at a minimum, a description of each serviceservice or UNE, the availability, the applicable rates and the installation intervals.
41.98.9. Within thirty (30) calendar days of its receipt of the BFR Quote, CLEC the requesting Party must either confirm, in writing, its order for the BFR pursuant to the BFR Quote or if a disagreement arises, seek resolution of the dispute under the Dispute Resolution procedures in Part B of this Agreement.Agreement.

41.542.5. Except under extraordinary circumstances, within thirty (30) calendar days of its receipt of a BFR, the Sprint Embarq ILEC shall provide to CLEC a preliminary analysis of such BFR.
41.642.6. Upon receipt of the preliminary analysis, CLEC shall, within thirty (30) calendar days, notify SprintEmbarq ILEC, in writing, of its intent to proceed or not to proceed.

41.4. 3.5.3 Within ten five (105) calendar days Business Days of its receipt, the Sprint shall acknowledge GTE’s receipt of the BFR, GTE shall acknowledge in writing its receipt of same and identify a single point of contact and any additional information needed to process the request.
41.5. 3.5.4 Except under extraordinary circumstances, within thirty (30) calendar days Business Days of its receipt of a BFR, the Sprint shall provide to CLEC a preliminary analysis of such BFR.
41.6. Upon GTE’s receipt of the preliminary analysisBFR, CLEC shallGTE shall provide a proposed price and availability date, within or GTE will provide an explanation as to why GTE elects not to meet US Xxxx Xxxx’s request. In cases of extraordinary circumstances, GTE will inform US Xxxx Xxxx as soon as it realizes that it cannot meet the thirty (30) calendar days, notify Sprint, in writing, of its intent to proceed or not to proceed.
41.7Business Day response due date. Sprint shall promptly proceed with the BFR upon receipt of written authorization from CLEC. When it receives such authorization, Sprint shall promptly develop the requested services, US Dial Tone and GTE will then determine their availability, calculate the applicable prices and establish installation intervals.
41.8. As soon as feasible, but not more than ninety (90) calendar days after its receipt of authorization to proceed with developing the BFR, Sprint shall provide to CLEC a BFR Quote which will include, at a minimum, a description of each service, the availability, the applicable rates and the installation intervals.
41.9. Within thirty (30) calendar days of its mutually agreeable date for receipt of the request.
3.5.5 Unless US Dial Tone agrees otherwise, all proposed prices shall be consistent with the pricing principles of the Act, FCC and/or Commission. Payments for services purchased under a BFR Quotewill be made upon delivery, CLEC must either confirmunless otherwise agreed to by US Dial Tone, in writing, its order for accordance with the BFR pursuant to the BFR Quote or if a disagreement arises, seek resolution of the dispute under the Dispute Resolution procedures in Part B applicable provisions of this Agreement.
41.103.5.6 Upon affirmative response from GTE, US Dial Tone will submit in writing its acceptance or rejection of GTE’s proposal. UNEs or combinations of UNEs not specifically covered by this Agreement, but which have previously been provided to another carrier by the receiving Party are not subject to the BFR process but shall be, at a minimum, offered to the requesting party on the same rates, terms and conditions under which they were provided to the third-party carrier, provided, however, Embarq will provision services upon Level 3’s acceptance of the price quote. The Parties will promptly negotiate an amendment to this Agreement to incorporate terms, conditions and TELRIC compliant rates for such UNEs or combinations of UNEs. BONA FIDE REQUEST PROCESS. 41.1. Sprint CenturyLink shall promptly consider and analyze CLEC PAETEC requests for unbundled network elements UNEs included in this Agreement and combinations that are not currently developed by SprintCenturyLink, network information that is reasonably required to determine what unbundled network elements UNEs it needs to serve a particular customer or development of and changes to Sprint CenturyLink work processes related to ordering, provisioning or installation of unbundled network elements UNEs with the submission of a Bona Fide Request (“BFR”) hereunder.
41.2. A BFR shall be submitted in writing on the Sprint CenturyLink Standard BFR Form and shall include a clear technical description of each request.
41.3. CLEC PAETEC may cancel a BFR at any time, but shall pay all reasonable and demonstrable costs of processing and/or implementing the BFR up to the date of cancellation.
41.4. Within ten (10) calendar days of its receipt, the Sprint CenturyLink shall acknowledge receipt of the BFR.
41.5. Except under extraordinary circumstances, within thirty (30) calendar days of its receipt of a BFR, the Sprint CenturyLink shall provide to CLEC PAETEC a preliminary analysis of such BFR. If applicable, the preliminary analysis shall confirm whether CenturyLink will offer access to the UNE, including whether it is technically or operationally feasible.
41.6. Upon receipt of the preliminary analysis, CLEC PAETEC shall, within thirty (30) calendar days, notify SprintCenturyLink, in writing, of its intent to proceed or not to proceed.
41.7. Sprint CenturyLink shall promptly proceed with the BFR upon receipt of written authorization from CLECPAETEC. When it receives such authorization, Sprint CenturyLink shall promptly develop the requested services, determine their availability, calculate the applicable prices and establish installation intervals.
41.8. As soon as feasible, but not more than ninety (90) calendar days after its receipt of authorization to proceed with developing the BFR, Sprint CenturyLink shall provide to CLEC PAETEC a BFR Quote which will include, at a minimum, a description of each service, the availability, the applicable rates and the installation intervals.
41.9. Within thirty (30) calendar days of its receipt of the BFR Quote, CLEC PAETEC must either confirm, in writing, its order for the BFR pursuant to the BFR Quote or if a disagreement arises, seek resolution of the dispute under the Dispute Resolution procedures in Part B of this Agreement.
41.10. If a Party to a BFR believes that the other Party is not requesting, negotiating or processing the BFR in good faith, or disputes a determination, or price or cost quote, such Party may seek resolution of the dispute pursuant to the Dispute Resolution provisions in Part B of this Agreement.
