19.06 Employees who are off on annual vacation, authorized leave of absence, illness/injury or lay off status throughout the entire period of the selection processchange of card bulletin will submit a preference sheet with choice of assignments prior to resuming duty.

Bulletining and Filling Positions. 12.1 Permanent 15.1 Bulletined positions may be filled temporarily by an immediately available employee pending the assignment of the successful applicant.
15.2 Any appeal against appointment must be made in writing within twenty-eight days from date of issue of award bulletin covering such appointment.
15.3 Appointments shall be made by the officer issuing the bulletin. Employees will be awarded positions in order of seniority provided they are qualified. The name of the appointees and positions temporarily vacated their seniority number will be included in the award portion of the next bulletin. If such employees return to work after one year, they will be required to exercise their displacement rights.
15.5 Bulletins will provide the following information; classification of position (if temporary, the expected duration), location (headquarters, if any), rates of pay, work cycle and whether or not living accommodations are to be provided and the type of living accommodations (i.e. hotel, white fleet etc.). Start times will also be shown on the bulletin where they are known. In no way is this to be construed or limiting the Company’s rights in regard to start times under Article 2.
15.6 Employees who are awarded a temporary vacancy in accordance with Article 15 may be required to remain on such vacancy for up to 90 days, but will be released if they are the successful
15.7 Temporary vacancies of less than twentyforty-five (2545) days which require required by the Company to be filled, may be filled shall be bulletinedby the senior qualified employee immediately available. Employees who do not exercise seniority to such temporary vacancies will not forfeit any seniority. Junior qualified employees immediately available must protect assignments in all instances.

15.10 Senior employees holding seniority in the higher classification will not lose such seniority if they do not apply for a position in the higher classification. Filling permanent positions:
(a) In the event that no qualified employee applies for appointment the position, the position will be offered to laid off employees in seniority order, who are qualified and who hold seniority in the classification. (See Articles 17.21 and 17.22)
(b) If positions remain unfilled, junior laid off employees will be forced, in inverse seniority order, and must protect the assignment. (See Article 15.15)
(c) If positions remain unfilled, they will be awarded to the senior employees bidding to establish seniority in that classification provided such employees possess the basic job requirements and are adaptable and suitable to be trained for the positions.
(d) If positions remain unfilled following the above process, the junior qualified employee holding seniority in the classification and working in a lower classification will be forced in inverse seniority order and must protect the assignment. (See Article 15.15)
15.12 Except in an employment security situation, senior qualified employees who could have applied for a permanent position in the same classification or in higher classifications in which they hold seniority, will not be permitted to displace a junior employee holding a permanent position until such time as they re-establish themselves, by bulletin, on a permanent job, in the classification.
a) Employees bidding from a permanent higher classification to a bulletined positionpermanent lower classification will not be entitled to any moving expenses or other expenses to move to the position awarded. Bulletining and Filling Positions. 12.1 Permanently vacated permanent positions shall be bulletined to the seniority group affected within ten (1O) days of their becoming vacant, and the date of assignment provided for in Article shall be within twenty-eight (28) days of the vacancy, or such longer period as is mutually agreed, except in cases where the vacancy has to be re-bulletined or in cases where the duties of the position are operational duties. In the latter case, where the vacancy occurs during the non-navigation season, the twenty-eight (28) day period may be deemed to expire the date of the opening of the next navigation season. Applicants bidding on more than one position on the same bulletin must state, in order, their choice of preference. They will also retain all rights in the former group until such time as they exercise their seniority in the new seniority group. Upon returning to their former seniority group, they will forfeit their rights in the employees upon requestgroup to which they had transferred.
4.8 In April and October of each calendar year the Company will issue a bulletin to each Region showing the machine and machine operators and their location currently in operation.
4.9 An employee awarded a bulletined position of 90 calendar days or less, whether a temporary position or temporary vacancy, will revert to their former regular assigned position on completion of the temporary assignment. Should their regular assignment no longer be in existence, they are free to exercise their seniority in accordance with their qualifications.

4.2 In filling temporary vacancies, the following will govern:
(a) A temporary vacancy due to the absence of the incumbent for any reason will be treated as follows:
(i) Such vacancies will be filled by promotion within the group affected. The various groups will be designated as follows:
1. First Floor and Lower Level: Human Resources, Public Affairs and Computer Services including Records 2. Second Floor: Passenger Services and Bus Garage 3. Third Floor: Finance
4. Fourth Floor: Rail Services including Car and Diesel Shops and Maintenance of Way Shops
5. Fifth Floor: Telecommunications
6. Sixth Floor: Purchasing In the process of filling a vacancy in accordance with the foregoing, a maximum of one cross move will be allowed for employees in Rate Groups 4 and above. For example, if there was a requirement to fill a vacancy at Rate Group 5, a Rate Group 5 employee could move across to that position and then a Rate Group 4 employee would be promoted to fill the remaining Rate Group 5. There would not be a move across at a Rate Group 5 and then another at a Rate Group 4. In the application of this process when there is no Rate Group 1 in a group the senior person occupying a Rate Group 2 in any other group will be given the first opportunity for advancement. The vacancy thereby created will be filled by the senior Rate Group 1 employee. Where a temporary vacancy has been filled in accordance with this Article, and a subsequent displacement or other event occurs whereby a senior employee is displaced or returns to work, such senior employee, pending the temporary vacancy is expected to last two weeks or more, may exercise his/her seniority over the employee who has occupied the position as a result of the floor move.
(ii) Upon the expiration of the temporary vacancy, the employees will revert to their regular positions.
(b) At Northern points, when temporary vacancies occur, the permanent employee at the location affected will have preference in filling vacancies over new hires. This will also apply when no bids are received for permanent positions.
4.3 New positions and permanent vacancies will be bulletined for a period of three working days. In bulletining positions a brief description of duties will be given. Employees desiring such positions will file their applications with the designated officer within that time and an appointment will be made within three working days after close of bulletin. Such position or vacancy may be filled temporarily pending an assignment. The name of the appointee will immediately thereafter be posted where the position or vacancy was bulletined.
4.4 Copies of all bulletins and names of applicants for new positions or vacancies will be furnished to the "President, ONEIU or designate".
4.5 An employee may withdraw his/her application for a bulletined assignment at any time up to and including the commencement of the effective date of the position. Should the senior applicant or applicants withdraw, remaining applicants will be considered without further bulletin. An employee appointed to a position cannot bid on his/her former position until it again becomes vacant unless affected by displacement.
4.6 When an employee has been absent from his former or her permanent position for a period of 12 consecutive months, his or her position will be bulletined immediately thereafter. Such an employee absent on account of illness or approved leave of absence will retain his/her seniority rights. Such an employee absent for other reasons will be terminated.
4.7 Employees declining promotion shall not lose their seniority.
(a) When major changes are introduced in the duties of a position,
(b) Employees shall be encouraged to learn the duties of other positions and every opportunity shall be afforded them to learn the work of such positions in their own time and during regular working hours when it will not unduly interfere with the performance of their regularly assigned duties. The supervisory officer may arrange with interested employees to exchange positions for short temporary periods without affecting the rates of pay of the employees concerned.
4.9 An employee on leave of absence or vacation when a vacancy occurs will not be debarred from claiming position and receiving the appointment, if entitled to it, providing that such claim is made immediately upon his/her return.
4.10 It is recognized that there may be instances when for purposes of stability, the company may wish to retain an experienced employee on a specific position. In such instances the employee may, at the discretion of the company, be offered a stabilization incentive to remain on the position rather than move to a higher rate. In like manner, another employee may be offered a stabilization incentive to refrain from displacing the experienced employee. The amount of the stabilization incentive will not exceed the difference in the respective rates of pay of the positions involved.
4.11 The following will apply in connection with bulletining and filling positions and temporary positions covered under Articles 4.1 and 4.13 respectively.
(a) Bids to lower rated positions will not be accepted.
(b) Cross bids will only be accepted in the following circumstances.
(i) From employees occupying positions in Rate Group 4 and higher, or
(ii) From an employee bidding to a position in another community, or
(iii) From an employee forced to leave a position because of a documented medical condition.
(iv) When an employee wishes to return to a position which he or she had held for more than three months prior to being displaced therefrom and the time elapsed since that displacement does not exceed their tenure of the position.

13.5 In the event there is a vacancy which cannot be filled immediately under the process described in this Article, the following shall apply:
(a) for classifications within Local 4285, qualified employees holding seniority in this group but working in another who have made their intentions known in writing to the crew calling department by January 15th of each year to cover such assignments, will be provided the opportunity to fill the vacancy in order of seniority. If the vacancy is less than one tour the employee may refuse without forfeiture of seniority and recall. If the vacancy is for a full tour duration or greater and the employee refuses they shall not forfeit seniority but will forfeit subsequent recall to that seniority group for a 12 month period. Should an employee accept assignment within this provision and choose not to return to their former seniority group upon completion of the Union disagree with the outcome from the Step 2 grievance, it shall have the right to take the issue to arbitration. Where it is not operationally feasible for the officer to assume such position, status or vacancy immediately upon return from leave of absence, the Corporation officer may be assigned to another position in the interim and will provide written notice be allowed to assume the Local Chairperson with the reasons for doing so twenty-five (25) days prior to the abolishmentposition, status or vacancy as soon as practicable within 30 calendar days. (iii) In the event there are no qualified employees on the spare list or laid off, the junior qualified assigned employees will be placed on the assignments provided an increase in rate is involved and only until other more junior employees have been trained.
12.9 When runs are rebulletined as provided for in Article 12.1, the run or runs affected will be declared vacant from the home terminal on the effective date of assignment to be specified in the bulletin.
12.10 When it is necessary to change an assignment between the general bids prescribed in Article 12.1 to the extent of an increase or decrease of 8 hours or more in a basic four-week period, the Local Chairperson concerned will be advised of the particulars and the assignment shall be declared vacant effective with the date of the changed conditions and the run shall be rebulletined.
12.11 During the period bulletins are posted as provided for in Article 12.3, vacancies will be filled from the spare list until the successful applicants take up their assignment.
12.12 Regularly assigned employees assigned to temporary vacancies shall, at the expiration of such temporary employment, be returned to their former regularly assigned positions.

Bulletining and Filling Positions. 12.1 Permanent 10.1 When vacancy occurs for which a replacement is required or a new position is created within the Bargaining Unit on the Northern Quebec Internal Short Line, the Company shall distribute, to all employees working on the Northern Quebec Internal Short Line, a notice of the position. A copy of the notice shall be delivered to all Local Chairmen and General Chairmen.
10.2 The name of the successful applicant shall be posted for the information of all employees working on the Northern Quebec Internal Short Line. All Local Chairmen/ General Chairmen shall be provided with names of successful applicants. If no candidate is appointed then the Local Chairman/General Chairman shall be so notified.
10.3 The notice of posting referred to (above) shall contain the following information:
(1) duties of the position;
(2) qualifications required;
(3) hours of work;
(4) salary;
(5) rest days; and
(6) work locations The job requirements as determined must be relevant to the position.
10.4 Senior qualified employees within each Bargaining Unit on the Northern Quebec Internal Short Line will be given first preference over qualified employees from other Bargaining Units when filling new positions or vacancies.
10.5 When a job is filled in accordance with the job posting procedure, the successful employee will undergo a reasonable trial and instruction period. Employees within any Bargaining Unit will be given consideration over new employees when a position is bulletined in another Bargaining Unit.
10.6 Employees who have been appointed pursuant to this Article, and who fail to meet the requirements of the job to which they have been promoted, shall return to their former position and they shall not lose their seniority in their former classification.
10.7 Bulletined positions may be filled temporarily vacated by an immediately available employee pending the assignment of the successful applicant.
10.8 Appointments shall be made by the supervisor issuing the bulletin. Employees will be awarded positions in order of seniority provided they are qualified. The name of the appointee and seniority number will be shown on the next bulletin. The successful applicant will be required to assume the position to which appointed within 15 days from the date of the award bulletin unless otherwise specified. This period may be extended if, due to unforeseen circumstances, the employee cannot be released to assume the position.
10.9 Any appeal against appointment must be made in writing within twenty-eight days from date of issue of award bulletin covering such appointment.
10.10 Employees will not be permitted to bid on any temporary vacancy in a lower classification prior to obtaining a regular position in such classification.
10.11 Employees not holding a permanent position in the classification in which they are working will forfeit their seniority in such classification coincident with a junior employee being awarded a permanent position in that classification.
10.12 A vacancy created as a result of an employee being on a leave of absence for an anticipated illness or injury which is required to be filled will be advertised as temporary. Should the employee not return to work for a period of more than twentyone year, the position, if required, will then be advertised as permanent unless otherwise agreed with the General Chairman. If such employees return to work after one year, they will be required to exercise their displacement rights.
