Buyer's Operations. Xxxxx agrees to operate in a professional manner while removing the Byproducts and agrees to follow any guidelines and safety and security requirements that may be established by American Crystal with regard to activities occurring on American Crystal property. Xxxxx agrees to procure and maintain continuing automobile and general liability insurance and provide American Crystal with evidence of such insurance upon request. Xxxxx agrees that all equipment used for transporting Byproducts will be in good working order and agrees to use only sealed trucks or trailers to prevent any spilling or leaking of water from the Byproducts during transport. Buyer shall be responsible for clean-up and removal of any Byproducts that may spill during transport.

Xxxxx agrees to use the Byproducts only in the location(s) specified in the Form 5. Buyer and American Crystal must complete a new Form 5 prior to storing or using the Byproducts in a new location.

Buyer's Operations. In conducting its operations with respect to the Timber and its use of the roads on the Property, Buyer shall comply with all applicable federal, state, and local laws, rules, and regulations, including, without limitation, applicable provisions of the Washington Forest Practices Act and the rules and regulations issued thereunder, the provisions of all governmental approvals and permits, and all laws, rules, and regulations relating to worker safety, fire protection and suppression, hazardous materials and substances, and road construction, repair, and maintenance. Buyer shall operate in accordance with best logging practices to avoid breakage and damage to the Timber and to excepted and adjoining timber. Buyer shall not alter or construct any road within the Property without Seller’s prior written consent.
